The acquisition of patent rights means that a patentee has an exclusive right to practice his/her patented invention and that the said patentee has the legal authority to prohibit others from practicing his/her invented invention. In other words, a patentee acquires a monopolistic and exclusive right in his/her invention. In addition, the Patent Act recognizes injunction (Article 126 of the Patent Act) and compensation for damages (Article 750 of the Civil Act, Article 128 of the Patent Act) in order to guarantee the patentee's rights. The elements of a claim in a patented invention and in an accused invention must be compared in order to acknowledge the constitution of patent infringement. The all elements rule is applied to the said comparison, which only acknowledges the constitution of patent infringement when a single entity practices all the elements of a claim in a patented invention. However, the phenomenon of joint entity or multiple actors in which patent infringement cannot be acknowledged under the principle of the all elements rule has recently increased. The joint infringement by joint entity or multiple actors means that the joint entity or multiple actors practice the elements of the one-process invention in parts. For example, in cases where a claim is composed of A and B, Y only practices A, while Z practices B. In this case, neither Y nor Z practices all the elements of a process invention. Therefore, the patent infringement is not recognized under the existing Patent Act. That is, even though a patentee's right is infringed, the effectiveness of patent rights is denied. In particular, in cases where joint entity or multiple actors practice another's process invention in parts, the patentee cannot seek any remedial measures. Thus, the significance of existence of patent rights is lost. The patent system has not anticipated the fact that a different legal force becomes effective based on the category of an invention. Upon recognition of this problem, this study examined the leading domestic and foreign case, theory, etc., and analyzed the legal principles therein to seek for a solution that would regulate the problem of joint patent infringement by joint entity or multiple actors. This study also examined the principle validity of the all elements rule or the single entity rule, which is a theoretical obstacle in resolving the problem of joint patent infringement by joint entity or multiple actors. In addition, this study aimed to suggest a solution for the problem of joint patent infringement by joint entity or multiple actors and a legal principle by involvement type of joint entity or multiple actors. Relevant academic circles apply the tool theory or the direct or control theory to the problem of joint patent infringement, as well as normatively evaluate the practice subject of a method patent. Also, there are theories that affirm the joint direct infringement when the objective and subjective requirements for the establishment of a joint principal offender are met for the joint patent infringement by joint entity or multiple actors, which is committed in the form of criminal joint principal offender. In addition, the precedents of the US, Japan, and Korea derived conclusions that are similar to the opinions of academic circles stated above. Meanwhile, the single entity rule has been understood as a rule that was derived from the all elements rule and the Court of Appeals for the Federal Circuit established in the BMC case (Resources, Inc. v. Paymentech, L.P. 498 F. 3d 1373 (Fed. Cir. 2007)). In addition, this rule has been understood as the single biggest obstacle to the recognition of joint patent infringement by joint entity or multiple actors. First, the fact whether a relevant process invention falls under the technological scope of an accused invention that a joint entity or multiple actors practice should be first determined through a claim interpretation in order to acknowledge the joint direct infringement of patent rights by joint entity or multiple actors that divide acts of practice. In addition, the nature of a relevant process invention or application of the doctrine of equivalents must be determined at the same time. The fact of who—among the joint entity or multiple actors—shall be liable for infringement must be determined in the premise thereon. As a method thereof, in cases where the liability is imputable to a single entity, the applicability of the tool theory or the direct or control rule must be examined. In addition, the applicability of the direct or control rule must be determined by comprehensively taking in consideration the personal and material aspects. Next, in cases where joint entity or multiple actors are equal in their relations and can be joint direct infringers, it must be based on the criminal joint principal offender theory. As such, it may be sufficient to determine by comprehensively taking in consideration the following—facts of joint practice as an objective requirement, continuous business relations, joint business relation, contribution rates of each member of a joint entity or multiple actors, attribution of economic interests, etc.—as the subjective requirement.
