연구 결과 먼저 체계적 문헌고찰에서는 검색된 총 4,382편의 문헌들 중 최종적으로 101편의 문헌을 검토하였다. 검토한 문헌들에서 밝힌 실제 진실말하기의 수행 및 경험 빈도의 편차가 심한 편이었지만, 대다수의 보건의료 종사자들은 진실말하기에 대한 의향을 밝혔고, 일반인들은 진실말하기에 대한 거의 절대적인 선호를 보였다. 진실말하기의 효과로는 의료소송 및 처벌 의향 감소, 의사에 대한 신뢰도 증가, 의사 추천 및 재방문 의향 증가, 의료 질 평가 점수 증가, 의사의 죄의식 감소 등을 확인할 수 있었다. 진실말하기의 장애요인으로는 의료소송 및 처벌과 관련된 요인, 보건의료 종사자와 관련된 요인, 환자와 관련된 요인, 진실말하기 수행 상황과 관련된 요인, 환자안전문화와 관련된 요인을 확인하였다. 반대로 촉진요인으로는 환자안전문화 형성, 진실말하기 정책 도입, 진실말하기 교육을 확인하였다. 다음으로 심층면접 및 초점집단토의에서는 총 34명의 참여자들을 대상으로 20번의 심층면접 및 4번의 초점집단토의를 진행하였다. 이를 통하여 진실말하기를 육하원칙이라는 측면에서 살펴보았는데, 구체적으로 ‘1. 왜 진실말하기를 해야 하는가’, ‘2. 언제 진실말하기를 해야 하는가’, ‘3. 언제 진실말하기를 시작해야 하는가’, ‘4. 무엇을 진실말하기에서 전달해야 하는가’, ‘5. 누가 진실말하기를 해야 하는가’, ‘6. 누구에게 진실말하기를 해야 하는가’, ‘7. 어디서 진실말하기를 해야 하는가’, ‘8. 어떻게 진실말하기를 해야 하는가’, ‘9. 어떻게 진실말하기를 촉진할 것인가’를 살펴보았다. 모든 의사와 일반인 참여자들은 진실말하기의 필요성을 당위적인 측면에서 인정하였다. 진실말하기의 알려진 효과들에 대해서도 참여자들은 대체적으로 수긍하였지만, 상대적으로 의사 참여자들이 의료소송 감소 효과, 의료진의 신뢰도 증가 등에 대한 효과에 회의적인 의견을 더 나타내었다. 심각한 위해를 초래한 의료오류의 경우 참여자들은 대체적으로 진실말하기가 필요하다는 입장이었지만, 근접오류에서 진실말하기가 필요한가에 대해서는 의사 및 일반인의 의견이 전반적으로 각각 부정적, 긍정적인 입장으로 나뉘었다. 참여자들은 대체적으로 진실말하기의 네 가지 요소들(사건 설명, 공감 표현 및 사건 조사에 대한 약속, 사과 전달, 적절한 보상에 대한 약속, 재발방지 약속 전달)의 필요성에 대해서 인정하였다. 대부분의 의사 참여자들은 진실말하기를 어떻게 해야 할지에 대해서 잘 몰랐고, 부적절하거나 완전하지 못한 진실말하기로 인한 부정적인 경험을 가지고 있는 경우도 있었다. 마지막으로 우리나라 국민을 대표할 수 있는 일반인 700명을 대상으로 가상적 사례를 이용한 설문조사를 시행하였다. 이번 설문조사로 거의 모든 일반인들이 진실말하기가 필요하다고 생각하고 있었고, 진실말하기의 효과에 대해서도 대부분의 응답자들이 긍정적인 의견을 가지고 있음을 알 수 있었다. 전체 가상적 사례의 응답 결과를 종합하여 회귀분석을 한 결과에 따르면, 진실말하기를 하는 경우는 그렇지 않은 경우에 비하여 가상적 사례에서의 의료오류 유무 판단의 오즈(odds)가 약 0.63배(95% 신뢰구간: 0.52~0.76) 낮았고, 재방문 의향의 오즈가 약 2.63배(95% 신뢰구간: 2.33~2.98) 높았으며, 추천 의향의 오즈가 약 2.44배(95% 신뢰구간: 2.11~2.81) 높았고, 의료소송 의향의 오즈가 약 0.41배(95% 신뢰구간: 0.36~0.47) 정도 낮았으며, 형사적 처벌 의향의 오즈도 약 0.44배(95% 신뢰구간: 0.39~0.50) 정도 낮았다. 뿐만 아니라 진실말하기를 하는 경우 그렇지 않은 경우에 비하여 의사의 신뢰도 점수가 약 1.24점(95% 신뢰구간: 1.15~1.34) 높았고, 적절한 보상 금액이라는 판단한 액수가 1,637만원(95% 신뢰구간: -2,573~-700) 정도 낮은 것으로 나타났다.

Objective Open disclosure of patient safety incidents is defined as series of process as follows: “When a patient safety incident occurs, medical professionals preemptively explain the incident to the patients and their caregivers, express sympathy and regret for the incident, deliver apology and compensation appropriately if needed, and promise to prevent recurrence.” Open disclosure of patient safety incidents is known for its effectiveness in improving the level of patient safety, reducing the number of medical lawsuits, and increasing the credibility of medical professionals. In this study, three substudies were conducted focusing on the assessment of the general public’s and medical professional’s perceptions of open disclosure of patient safety incidents to introduce policies for open disclosure of patient safety incidents in South Korea.
Methods This study is divided into three sections to comprehensively examine open disclosure of patient safety incidents. The first section systematically reviews the frequency, effect, obstacles and facilitators of open disclosure of patient safety incidents reported by previous studies. The second section examines in-depth perceptions of open disclosure of patient safety incidents of the general public and medical professionals, using methods of qualitative research, such as in-depth interviews and focus group discussions. The third section confirms the effect of open disclosure of patient safety incidents, using a survey based on hypothetical cases, conducted on the general public. Desired effects of open disclosure of patient safety incidents, such as decrease in the likelihood of legal action and increase in the credibility of medical professionals, were confirmed.
Results First of all, in the systematic review, 101 articles were selected for qualitative synthesis among 4,382 articles identified by database search. There was quite a variation in the reported frequency of medical professionals’ open disclosure of patient safety incidents. However, the majority of medical professionals clarified their willingness to perform open disclosure of patient safety incidents. The majority of the general public were completely supportive of open disclosure of patient safety incidents regardless of types of patient safety incidents. The effects of open disclosure of patient safety incidents were confirmed as follows: decrease in the intention of the general public to file medical lawsuits and punish medical professionals, increase in the credibility of medical professionals, increase in the intention of revisiting and recommending the physicians or hospitals. rise in the evaluation score for quality of care, ease in the medical professionals’ guilty feelings and so on. The obstacles of open disclosure of patient safety incidents were confirmed as follows: fear of medical lawsuits and punishment, fear of losing professional reputation among colleagues and patients, diminished patient trust when open disclosure of patient safety incidents is performed, complexity of situations regarding the conduct of open disclosure of patient safety incidents, and absence of patient safety culture. Meanwhile, establishment of patient safety culture, introduction of policy for open disclosure of patient safety incidents, and development of education and training program for open disclosure of patient safety incidents were identified as facilitators of open disclosure of patient safety incidents. In the qualitative research, four focus group discussions and twenty in-depth interviews were conducted on 34 participants. By analyzing the verbatim transcriptions, perceptions of open disclosure of patient safety incidents were summarized in terms of five W's and one H. The specific categories were as follows: “Why should medical professionals conduct open disclosures?”, “When should open disclosures be performed?”, “When should open disclosures start being conducted?”, “What should medical professionals convey in open disclosures?”, “Who should conduct open disclosures?”, “To whom should medical professionals conduct open disclosures?”, “Where should open disclosures be conducted?”, “How should medical professionals conduct open disclosures?”, and “How should open disclosures be facilitated?” All physician participants and the general public participants acknowledged the normative justifiability of open disclosure of patient safety incidents. The participants mostly agreed on the known effects of open disclosure of patient safety incidents, but the physician participants relatively had negative opinions on the effects, such as decrease in the intention of the general public to file a medical lawsuit, and increase in the credibility of medical professionals. Generally, the participants thought that open disclosure of patient safety incidents is required in the case of major errors. However, the physician participants and the general public participants had contrary opinions on the necessity of open disclosure of patient safety in the case of near miss. The participants in general acknowledged the necessity of four main components of open disclosure of patient safety incidents (explaining patient safety incidents; expressing sympathy and regret and promising an investigation on patient safety incidents; making an apology; and promising to avoid recurrence). The majority of physician participants did not know how to conduct open disclosures and some physician participants had bad experiences due to inappropriate or incomplete open disclosures of patient safety incidents. Finally, a survey questionnaire using hypothetical cases was conducted on 700 respondents who apporpriately represent the general public of South Korea. Almost every respondent (699, 99.9%) recognized the need for open disclosure of patient safety and the majority of respondents expressed positive opinions on the effects of open disclosure of patient safety incidents. According to the pooled analyses on the entire hypothetical case, the predicted odds for open disclosure of patient safety incidents in the judgement of medical errors was 0.63 times lower than the odds for no disclosure of patient safety incidents (95% confidence interval (CI): 0.52~0.76). The odds of intention of revisit and recommendation for open disclosure of patient safety incidents were 2.63 times (95% CI: 2.33~2.98) and 2.44 times (95% CI: 2.11~2.81) higher than those of no disclosure of patient safety incidents, respectively. Furthermore, the odds of intention of medical lawsuit and criminal charges for punishment for open disclosure of patient safety incidents were 0.41 times (95% CI: 0.36~0.47) and 0.44 times (95% CI: 0.39~0.50) lower than those of no disclosure of patient safety incidents, respectively. Moreover, the trust score of a physician was 1.24 points higher in open disclosure of patient safety incidents compared to no disclosure of patient safety incidents (95% CI: 1.15~1.34). Appropriate amount of compensation was 1,637 (10,000 won) lower in open disclosure of patient safety incidents compared to no disclosure of patient safety incidents (95% CI: -2,573~-700).
Conclusion In this study, various aspects of open disclosure of patient safety incidents were reviewed focusing on the perceptions of the general public and medical professionals. Similar to the previous studies, the general public of South Korea showed their yearning and unconditional support for open disclosure of patient safety incidents. The effects of open disclosure of patient safety incidents, identified through hypothetical cases in this study, yielded a more positive outlook on introducing open disclosure of patient safety incidents. Henceforth, developing guidelines for open disclosure of patient safety incidents, enacting apology law to ensure open disclosure of patient safety incidents, and developing of education programs for open disclosure of patient safety incidents should be of priority to introduce open disclosure of patient safety incidents in South Korea.

Generally, the participants thought that open disclosure of patient safety incidents is required in the case of major errors. However, the physician participants and the general public participants had contrary opinions on the necessity of open disclosure of patient safety in the case of near miss. The participants in general acknowledged the necessity of four main components of open disclosure of patient safety incidents (explaining patient safety incidents; expressing sympathy and regret and promising an investigation on patient safety incidents; making an apology; and promising to avoid recurrence). The majority of physician participants did not know how to conduct open disclosures and some physician participants had bad experiences due to inappropriate or incomplete open disclosures of patient safety incidents. Finally, a survey questionnaire using hypothetical cases was conducted on 700 respondents who apporpriately represent the general public of South Korea. Almost every respondent (699, 99.9%) recognized the need for open disclosure of patient safety and the majority of respondents expressed positive opinions on the effects of open disclosure of patient safety incidents. According to the pooled analyses on the entire hypothetical case, the predicted odds for open disclosure of patient safety incidents in the judgement of medical errors was 0.63 times lower than the odds for no disclosure of patient safety incidents (95% confidence interval (CI): 0.52~0.76). The odds of intention of revisit and recommendation for open disclosure of patient safety incidents were 2.63 times (95% CI: 2.33~2.98) and 2.44 times (95% CI: 2.11~2.81) higher than those of no disclosure of patient safety incidents, respectively. Furthermore, the odds of intention of medical lawsuit and criminal charges for punishment for open disclosure of patient safety incidents were 0.41 times (95% CI: 0.36~0.47) and 0.44 times (95% CI: 0.39~0.50) lower than those of no disclosure of patient safety incidents, respectively. Moreover, the trust score of a physician was 1.24 points higher in open disclosure of patient safety incidents compared to no disclosure of patient safety incidents (95% CI: 1.15~1.34). Appropriate amount of compensation was 1,637 (10,000 won) lower in open disclosure of patient safety incidents compared to no disclosure of patient safety incidents (95% CI: -2,573~-700).
Conclusion In this study, various aspects of open disclosure of patient safety incidents were reviewed focusing on the perceptions of the general public and medical professionals. Similar to the previous studies, the general public of South Korea showed their yearning and unconditional support for open disclosure of patient safety incidents. The effects of open disclosure of patient safety incidents, identified through hypothetical cases in this study, yielded a more positive outlook on introducing open disclosure of patient safety incidents. Henceforth, developing guidelines for open disclosure of patient safety incidents, enacting apology law to ensure open disclosure of patient safety incidents, and developing of education programs for open disclosure of patient safety incidents should be of priority to introduce open disclosure of patient safety incidents in South Korea.
