본 연구는 청소년현장에서 안전사고 발생 시 청소년지도자에게 부여되는 부당한 사고책임전가와 인권침해로부터 청소년지도자를 보호하고, 그들에게 적절한 안전의식과 관련 지식을 습득하게 하기 위하여, 청소년지도자에 대한 전반적인 안전의식을 설문조사를 통해 알아보고, 지도자의 책임범위와 그 법률적 판단기준을 알아보기 위하여, 관련 판례·사례분석을 실시하였다. 이를 위해, 첫째, 2016년 08월 ~ 09월까지 서울·경기·인천지역 청소년지도자 262명을 대상으로 안전의식에 관한 설문을 실시하였다. 둘째, 청소년안전사고 관련 총 48건의 판례와 사례들을 분석하여 지도자에게 부여되는 안전사고의 책임범위와 그 판단기준을 도출하였다.

활동시간 외 발생한 안전사고와 관련해서, 휴식시간, 이동시간, 숙박시간 등 활동 외 시간 전반에 걸쳐서도 지도자의 관리감독의 책임이 요구되고 있으며, 이동시간의 경우, 이동수단별 적절한 주의의무가 부여됨도 알 수 있었다. 숙박시설에서 청소년지도자는 청소년들을 관리·감독하는데 있어 합리적인 생활수칙과 기준에 따라 지도해야하며, 이에 대한 사전교육 실시, 시설에 대한 사전안전점검 및 주의의무의 이행여부들이 지도자의 주요한 책임판단기준이 되고 있었다.
이러한 결과에 입각하여, 본 연구자는 청소년지도자의 안전감수성 증진, 활동유형별 주의의무 및 안전배려의무 인식증진, 활동 외 시간에 요구되는 관리·감독의 책임 인식증진, 참가청소년의 욕구, 건강, 심리상태 등을 고려한 전문적 지도능력 향상 등 지도자 인식개선 사항을 지적함과 동시에 이를 위한 안전교육 매뉴얼 개발과 교육기회의 확산, 그리고 관련 법률적 제도전 개선을 제언하였다. 그리하여, 사후처리보다는 예방중심의 청소년안전사고대책이 필요하며, 특히 사고 시 청소년지도자가 당할 수 있는 부당한 책임전가와 인권침해를 막기 위한 법률적 보호장치 및 관련 기구의 설치와 이를 위한 지속적인 연구의 필요성을 제시하였다.

This study investigated the overall safety awareness of youth workers through a questionnaire survey to protect youth workers from unjustified accident liability and human rights violations that are unfairly given to youth workers and to have them acquire proper safety awareness and relevant knowledge when a safety accident occurs in the youth work field, and conducted case analysis with related cases to examine the range of responsibility of leaders and their legal criteria. For this, first, this study conducted a survey for safety awareness on the subjects of 262 youth workers in Seoul, Gyeonggi and Incheon regions from August to September 2016. Second, a total of 48 cases with judicial precedents related to youth safety accidents were analyzed and the range of responsibility of safety accidents granted to the leader and its criteria were derived. The main results of this study are as follows. To look at the main results of the survey of youth workers' awareness of safety accidents, first, the possibility and risk of accident by the leaders themselves were perceived to be relatively low as compared with the possibility of safety accidents based on the characteristics of youth and educational activities. And, by institution type, it is perceived that it is more likely to have an accident in a natural zone training facility than a living zone training facility. The responsibility for the types of safety accidents was perceived to be relatively more responsible for leaders than for other subjects such as supervisors and parents. As for the causes of accidents by type, it was recognized that there are multiple causes such as carelessness and lack of consciousness of youth workers, violation of laws, and stresses in all types except facility environment. To prevent safety accidents, the need for safety education and the improvement of safety awareness of the leader were relatively high compared to the improvement of the safety environment, safety management, and related laws and regulations. Next, the main results of the scope of responsibility of youth workers in safety accidents and their legal judging criteria, which are learned through analysis of cases with judicial precedents are as follows. To look at the major legal criteria given to youth workers when youth safety accidents occurred, the consequences of safety accidents, the causal relationship between carelessness and negligence of youth workers, the predictability of the accident, preliminary education, preliminary safety check, and follow‐up management related to the safety care obligations of youth workers are the main legal judgment criteria. In addition, the obligation of safety consideration requires special measures to be taken for each activity type, such as indoor activities and outdoor activities. There was also a difference in the obligation of safety consideration emphasized by outdoor activity types such as marine and water activities, encampment and camping activities, and physical and athletic activities, etc. It was also a major legal criterion to consider whether or not the youths' maturity, health status and psychological status were properly considered, and whether the leader had professional qualifications based on the activities and whether the leader had the qualification criteria. Regarding the safety accidents that occur outside the activity hours, responsibility for supervision and supervision of the leaders is required throughout the activity time such as break time, transfer time, and stay time. This study suggests the development of safety education manual, proliferation of education opportunities, and improvement of related legal improvements. Thus, it is necessary to take preventive measures against youth safety accidents rather than post‐treatment. And, this study presented the necessity of continuing research and establishment of legal protection apparatus and related organizations to prevent illegal responsibilities and human rights violation that youth workers can suffer especially in case of an accident.
