Korea and China are mutually friendly neighboring countries in proximity, which have shared a long history of interactions and a very similar cultural background. These are favorable conditions for trade development between the two countries. Because the two countries are in different stages of development, their relation is complementary in structure. The recent increase in trade transactions between the two countries confirm that they are partners who rely on each other for trade. Since the establishment of diplomatic relations between Korea and China in 1992, Korea-China relations have continued to grow. Especially since China's entry into WTO in 2001, the volume of transactions has rapidly increased. In 2002, Korea overtook Japan and China’s second largest trade partner and Korea became the second largest export market for China. In 2003, China overtook the U.S. and became Korea’s largest export market. Until the end of 2007, China was South Korea's largest trading partner and the country with which it had the largest trade surplus. In 2009, trade cooperation between the two countries continued to intensify; during the global financial crisis, the level and quality of Korea-China trade cooperation continuously improved, further expanding the areas of goods included in trade. At the present, China remains established as Korea’s largest trade partner. The two countries also overcame the 2010 global financial crisis together. Furthermore, the statistics on Korea's exports by country in 2016 confirm that in recent years, China has remained at the top of the list without any change in ranking. Meanwhile, the statistics on Korea's imports by country also show that the rankings from the first to the third remain unchanged. China has become Korea's largest trading partner, the largest export and import market, the largest source of trade surplus and the largest investment destination, and meanwhile, Korea has become China's third largest trade partner, second largest source of imports, and the fourth largest destination for exports. The rapid development Korea-China trade since the turn of the century has also led to an increase in trade disputes between the two countries. A study of these disputes with a focus on preventing conflicts between Korea and China and identifying measures for conflict resolution will make an important contribution to the stability and longevity of the trade development between the two countries. In this paper, we researched the disputes in terms of various trade patterns between Korea and China. When the disputes were classified by the cause, the largest number were found to be over payment on export, failure to perform the terms of a contract upon importation, and defective quality. According to information from the China International Economic and Trade Arbitration Commission (CIETAC), in general, trade transactions are largely transactions between persons in remote places and due to differences in commercial practices, language, culture, and institutions, etc., disputes occur frequently between such trading partners. When a trade dispute occurs, various expenses such as the cost of labor and shipping and warehousing costs tend to increase, and these issues may have a major impact on the normal operation of the business and furthermore, they can also have a negative impact on a company’s image. The following identifies the problems and proposes corresponding solutions. First, business persons should obtain a stronger awareness of the importance and necessity of trade disputes, and inform themselves accurately about the other party's credit status. The contents of the contract and the dispute settlement provision must be clearly established in writing. Also, cares should be given to contract management to prevent trade disputes. Secondly, in trade transactions, there are cases in which the partners are exposed to losses because the trade process is simplified and the contract is not formally concluded in the rush to meet a transaction timeline for a commodity that is prone to quick turnovers. Preparing clear provisions of a written contracts may prevent conflicts, and it helps to resolve disputes efficiently. Third, as China is Korea's top trading partner, we cannot overemphasize the importance of Contracts for the International Sale of Goods. When Korean companies sign Contracts for the International Sale of Goods (CISG) with China, they need to be equipped with an understanding of Chinese contract law as well as an overall comprehension of the rules governing international trade. Fourth, in the event of a commercial dispute with China, Korean companies ought to opt for an alternative dispute settlement other than a trial, such as arbitration or mediation, which are less subject to administrative interference. They should take caution not to be disadvantaged in handling similar cases by accumulating case studies of commercial dispute resolutions. Fifth, companies should ensure that the contract contains a valid arbitration clause to establish legal grounds for the settlement of future disputes. For this purpose, they should actively utilize the standard arbitration clause recommended by the Korean Commercial Arbitration Board (KCAB) or the arbitration clause recommended in the Agreement established between Korea and China on arbitration. Sixth, it is necessary to establish a professional credit evaluation agency and an arbitration institution jointly approved by South Korea and China. In addition to the approach of resolving issues between the countries through the bilateral arbitration agreement, it is necessary to establish a common dispute resolution organization to resolve disputes jointly through the participation of the arbitration institutions of both countries. The organization will work with the arbitration agencies of the two countries to jointly handle disputes; international trade disputes between parties from Korea and China should be resolved through arbitration or other means rather than litigation. Records should be kept of the credit status and business conditions of the trading parties respectively from China and Korea, as well as records of how each dispute was resolved. The organization will thus have the effect of practically providing a credit check of companies in Korea and China. Seventh, when concluding a cargo insurance contract in a real trade transaction, the parties should consider the terms of the sales contract, especially the terms and conditions of trade provided in the contract and the contents of Incoterms, etc. If necessary, special clauses should be inserted to amend the terms and conditions of the insurance coverage period and the time of termination. Eighth, the governments of South Korea and China need to clarify their official position and cooperation plans. The Korean government needs to thoroughly examine and investigate whether the contents of the laws and regulations of the Chinese government may adversely affect Korean companies' exports and investment ventures in China. South Korea should seek to participate in large-scale projects promoted by the Chinese government at the national level and invested in development projects in western China in cooperation with overseas Chinese companies. By thus contributing to Chinese society, South Korea should demonstrate itself to be a true partner of China. As indicated above, many disputes have hitherto occurred because SMEs lacked knowledge about disputes and trade practices or were ignorant on ways to prevent and handle such disputes. Therefore, we need to provide specific education on the professional arbitration system and solution methods available in both Korea and China. In particular, high priority should be given to education on the pros and cons and convenience of various dispute resolution methods. Korean companies should reduce their vulnerability by thoroughly preparing themselves with education on the cultural conventions and negotiating strategies common among Chinese people and preparing countermeasures. Offering education on dispute resolution is therefore of utmost importance. South Koreans should also be aware of the convention of interpersonal relations in China referred to as “GUANXI”: because of this convention, it is important to quickly identify which Chinese negotiators have decision-making authority.

When a trade dispute occurs, various expenses such as the cost of labor and shipping and warehousing costs tend to increase, and these issues may have a major impact on the normal operation of the business and furthermore, they can also have a negative impact on a company’s image. The following identifies the problems and proposes corresponding solutions. First, business persons should obtain a stronger awareness of the importance and necessity of trade disputes, and inform themselves accurately about the other party's credit status. The contents of the contract and the dispute settlement provision must be clearly established in writing. Also, cares should be given to contract management to prevent trade disputes. Korean companies should reduce their vulnerability by thoroughly preparing themselves with education on the cultural conventions and negotiating strategies common among Chinese people and preparing countermeasures. Offering education on dispute resolution is therefore of utmost importance. South Koreans should also be aware of the convention of interpersonal relations in China referred to as “GUANXI”: because of this convention, it is important to quickly identify which Chinese negotiators have decision-making authority.
