This paper analyzes the behavior of the Ministry of Land, Infrastructure and Transport and the Seoul Metropolitan Government on night time area passenger transport business in Seoul from August 2015 to October 2016 based on the innovation resistance theory. Although existing regulatory theory has placed government as the moderator of the regulations, the actual behavior of government in the case is close to innovation resistance behavior as an actor against regulatory innovations, regulation 2.0. Regulation 2.0, unlike previous regulations (Regulation 1.0) through licenses and laws, is a new form of regulation which pre-restricts participants ' behaviors by Code, which organizes the cyber space and is updated in real time based on data and feedback. In this paper, the government’s behavior was analyzed based on the analysis frame of the innovation resistance theory into the perceived innovation characteristics, consumer characteristics, and propagation mechanisms. As a result of the analysis, Regulation 2.0 was socially appropriate in terms of perceived innovation characteristics, but it had characteristics incompatible with Regulation 1.0 and could not be modified or withdrawn after its current legal system was adopted. From consumer characteristics, the government is apt to resist to innovation because it has the nature of bureaucracy. The media and statements used by CallbusLab in the propagation mechanisms were largely Impersonal, less specialized in regulations, and insufficient information on regulatory 2.0 to provide for the government.
