In this study, the regulations on health functional food (HFF) of Korea and the health-related products corresponding to HFF of Korea in foreign countries were analyzed and the problems in the regulations were figured out, and the improvements were suggested accordingly. Since Korean Health Functional Foods Act was enacted in 2004, the domestic health functional food industry has steadily grown, with the market size reaching 2.275 trillion won in 2018, up 10.6 percent annually over the past 10 years in Korea. The number of functional categories and HFF products was 9 and 310, repectively, in 2004, and expanded to 33 and 23,899 in 2018. HFF products are being developed and marketed reflecting the needs and expectations of consumers. The global health related foods market has continued to expand with total sales reaching approximately $128.6 billion in 2017, and the average growth rate over the 10-year period has continued to grow at 5.9 percent. In line with the growth of the HFF industry, the regulations on HFF should also be reasonably improved. The United States, Japan, China, and European Union(EU) countries regulate HFF by classifying them as food categories as well as Korea, however, Canada and Australia classify them as medicine categories. Regulation system of HFF are differ among various countries. Good Manufacturing Practice (GMP) application are required in HFF manufacturing facilities in Korea as well as the United States, Australia, and Canada. The current Korean regulations on HFF were analyzed by stages, pre-requisit prior to manufacter and import, and management stages, the manufacturing and import management stages, and the post-marketing distribution and sales stages of the HFF in Korea, and the following improvement measures were suggested. Moreover, it is suggested to establish a ‘Supporting center for standard material and clinical study’ for reinforcing by management of specification and criteria by testing with quality assurance and objectiveness in clinical study. In this study, nine unnecessary evaluation items were selected and analyzed, based on the results reported by MFDS (P < 0.05). It is suggested that the items unnecessary for evaluation should be deleted, and evaluation assessment items such as hazardous management that require intensive assessment were suggested to be subdivided. For fair evaluation between imported and domestically produced HFF not to generate any reverse discrimination, GMP regulation may be applied to foreign inspection of HFF. In this study, it is suggested that all information should be disclosed transparently at the stage of post-marketing so that consumers can easily accessible to the abnormal cases, daily dosage and similar adverse reports in order to prevent careless consumption of multiple HFF simultaneously. In addition, abnormality report and symptom classification were suggested to improve the reporting and method of reporting table for abnormalities. Moreover, it may recommend to minimize relationship with MFDS for preventing potential unconstitutional issue owing to lack of the autonomous deliberation system and functional labeling and advertising food regulation of manufacturer.
