There has been a sharing economy in the past to recycle or use existing goods, but with the development of ICT, sharing economy providers who continuously and repeatedly engage in sharing economy activities through online platforms have emerged. The development of the sharing economy has resulted in a variety of economic and social benefits such as increased consumer profits, employment creation, economic revitalization, and environmental preservation. Meanwhile, as the sharing economy platform, which mediates the sharing economy, has become global and larger, sharing economy activities have caused conflict with existing industries. With the development of the sharing economy, the sharing economy has been studied in two main ways: one is an empirical research method that studies the benefits and perceived risks of participants in the sharing economy, and the other is a legal and policy research method to regulate the sharing economy. The empirical research method studies the benefits of the sharing economy while neglecting the fact that the sharing economy violates the current law. On the other hand, the legal and policy research method emphasizes that the sharing economy should be legally regulated, rather than that the sharing economy is being used in various ways in real life. These two research methods are not mutually opposed. In empirical studies on the sharing economy, the perceived risk factor for the sharing economy(low-quality perception, trust issues, economic and environmental issues, legal issues, host risk, security/privacy risk) becomes the regulatory cause of the sharing economy in legal and policy studies. In the end, the two research methods can be seen as having a close relationship. From this point of view, this study research the future direction of law improvement based on legal and policy issues concerning the sharing economy based on the current law. At the same time, from the perspective of empirical research on the sharing economy, this study research whether this study can contribute to the revision of the law by reflecting the results of empirical studies on the sharing economy in the future. This is because the results of empirical research reflecting the real society must be reflected in the future revision of the law about the sharing economy to become a method of solving the current sharing economy situation where there is a gap between reality and laws and giving effect to new laws. A typical example of the sharing economy is car sharing(Uber) and accommodation sharing(Air BnB), and car-sharing was legislatively resolved to some extent by the revision of the ‘Passenger Transport Service Act’ in March 2020. So it was decided to use Airbnb, a platform for sharing accommodation, as the subject of the study. And this study conducted a case study of each country's case and Korea's case on Airbnb. To have the logic of case studies, data were collected through various channels and social phenomena were constantly monitored during the research period. At the end of each issue of the study, alternatives were presented and various data were reviewed. In this study, the legal and policy issues of accommodation sharing platforms were divided into problems with existing businesses or current laws, taxation of accommodation sharing, external diseconomies problems due to accommodation sharing, protection of consumers, an online service provider issue, platform monopoly, and fair competition, and each issue was studied. The theoretical implications identified through this study are that the current social phenomena can be identified through empirical research on legal and policy issues of accommodation sharing and that empirical research on accommodation sharing should be reflected in legislation on accommodation sharing in the future.
