인공지능으로 생성된 생성물의 지식재산권적 쟁점을 살펴보면, 저작권적인 관점에서는 인공지능의 저작자가 누구인지에 대한 여부가 발생한다. 인공지능으로 생성된 저작물의 경우, 약한 인공지능으로 산출된 저작물이라면 저작자를 이용자로 보는 것이 타당하나, 강한 인공지능의 경우에는 저작자가 누구인지를 특정할 수 없다는 맹점이 있다. 특허의 경우, 인공지능은 발명자의 지위를 가질 수 없고, 다만 발명자주의의 예외인 직무발명 제도를 유추하여 검토될 수 있다. 인공지능으로 생성된 생성물의 침해가 발생하였을 때에는 약한 인공지능의 경우 민형사적인 책임을 물을 수 있으나, 강한인공지능과 초인공지능에게는 민형사상의 책임의 부과가 어렵다.
이외에도 인공지능 생성물의 이용과 관련된 법제도적 개선방안을 고찰하였다. 약한 인공지능에서는 저작권법과 특허법에 있어 별도의 인공지능특별법의 제정 없이 본 편에 하나의 장으로 삽입하는 것이 적당하나, 강한 인공지능 단계에서는 현행 지식재산권법으로 다루기에는 한계가 있으므로 별도의 특별법을 제정하는 것이 타당하다.

We considered how artificial intelligence is being treated in this field of knowledge property, citing overseas examples.
Looking at the intellectual property rights issues of products generated by artificial intelligence, from a copyright perspective, whether or not the author of artificial intelligence is raised. In the case of works produced by artificial intelligence, it is reasonable to regard the author as a user if the work is produced by weak artificial intelligence, but in the case of strong artificial intelligence, it is impossible to specify who the author is. In the case of patents, artificial intelligence shall not have the status of an inventor, but it may be examined by inferring the job invention system, which is an exception to inventorism. In the event of infringement of products produced by artificial intelligence, civil and criminal responsibility can be imposed on weak artificial intelligence, but it is difficult to impose civil and criminal responsibility on strong artificial intelligence and super-artificial intelligence.
