However, the learning process of AI causes various legal problems such as unauthorized use and duplication of copyrighted works protected under the Copyright Act. In Korea a work means a creative work that expresses human thoughts or emotions. The author is defined as the creator of the work, so artistic output or creations created by AI through its own creative process without human intervention are not recognized as works. This is the same for most countries such as the United States, Germany, France, and China. However, there are countries such as the UK, Ireland, New Zealand, India, Hong Kong, etc. that recognize copyrights in AI creations, and there are relevant guidelines from the European Union that systematically promote the use of copyrighted works used in the AI creation process, and the Copyright Act of Japan, Singapore, Switzerland and Estonia, etc. International countries are responding strategically to preoccupy the AI era, While embodying the value of human-centered and transparent development of copyright-related discussions on AI, It seems that considerable progress has been made in reorganizing, enacting and revising specific issues in the Copyright Act or Intellectual Property Rights Act. Therefore, it is time for Korea to future-proof the AI era by removing the legal uncertainty regarding the use of big data which is expanding due to the breakthrough of ICT, the use of copyright-protected works in the AI learning process, creations by AI. In addition, it is necessary to thoroughly review the introduction of a reasonable system to achieve a harmonious and fair copyright market that does not unduly infringe on the legitimate interests of authors without conflicting with the normal and fair use of works. And through pan-governmental governance, It seems that it is necessary to fully consider international discussions with international organizations and the European Union etc., AI-related guidelines and laws newly introduced in major countries, development trend and market status of AI industry in Korea. and It seems that it is necessary to reflect the opinions of various entities such as copyright holders, developers and owners and users of AI, distributors and users of copyrighted works.
