Nowadays, North Korea has 60 percent of its residents suffering from absolute poverty and complaining of economic difficulties. However, some classes are living through informal economic activities and stratifications are occurring. Considering the economic differences with South Koreans after unification, the absolute poverty of North Koreans is thought to act as a hindrance to social integration. The issue of minimum living security in North Korea will be an important issue. Therefore, this study aims to prevent a legal vacuum to guarantee the minimum living security of North Koreans suffering from poverty after unification by devising measures to integrate the two different system of social security between South Korea and North Korea. The poverty problem is specified as a national responsibility in Article 10 of the Korean Constitution in guaranteeing human dignity and the right to a humane livelihood under Article 34. Based on the principle of welfare state, the government should guarantee basic social rights to help increasing the happiness of people. Article 34 (5) of the Constitution standardized the basic right to protect the poor without livelihood maintenance ability. This is embodied through legislation and ‘the National Basic Living Security Act’ was enacted for the purpose of minimum living security under South Korean legal system, and other social insurance laws such as ‘the National Pension Act’, ‘the Employment Protection Act’, ‘the Industrial Accident Compensation Insurance Act’, and ‘the Social Welfare Act’ indirectly function for guaranteeing minimum living security. On the other hand, due to the nature of the socialist system, North Korea does not recognize poverty, thus there is no special purpose law for maintaining the minimum living. However, ‘the Socialist Constitution of the Democratic People’s Republic of Korea’ guarantees all North Koreans the public distribution system which provides the necessaries of life. Moreover, there is a system corresponding to South Korea's social insurance system, such as unemployment benefits and old-age pensions, in case they lose their labor capacity. But the North Korean system is practically not functioning at all due to severe economic difficulties, and the North Koreans are not protected from the minimum living security. These different systems make sense to have a transition period to minimize side effects of unification given the serious economic and social gap between South Korea and North Korea and the serious reality of poverty in North Korea. Regarding social security system, it is more reasonable to apply the South Korean system to the North Korean region during that period, with the lower level of social security benefits to North Koreans in consideration of North's economic situation and income level. At this time, the legal problem caused by differentiating the residents of North Korea can be overcome by the possibility of rational discrimination of equal rights. Unification cannot remain in a transitional stage, and ultimately, it must move to the stage of true integration of the political, economic, and social spheres of South Korea and North Korea, besides new plan must be prepared for this. A new minimum living security system to be applied to the North Korean region should be devised. The minimum living security system should guarantee real equality for North Koreans and to maintain a healthy and cultural life. The government should take steps to inject social security funds. The new idea of the minimum living security system can consider a plan to improve the current system in South Korea and a plan to introduce a new system called ‘basic income’. The introduction of basic income is not suitable because discussions are still in the early stages in South Korea. Therefore, focusing on the limitations of the current South Korean system, it should be considered improvement point of them. As discussed earlier, it is necessary to solve the problem of blind spots in supply and demand under ‘the National Basic Living Security Act’ and ‘the National Pension Act’. The value of minimum living security is ultimately to help North Koreans escape their dependence on welfare and achieve true independence and self-realization in the new system. To this end, the integrated social security system of South Korea and North Korea needs a prerequisite. It is the establishment of an economic foundation in the North Korean region and employment system responding to social anxiety factors such as unemployment and employment instability. In the process of integrating the social security system, it is expected that there will inevitably be many national finances that are invested in public assistance and social security systems to ensure the minimum living of North Koreans. As a result, there may be concerns about the huge burden of unification costs, but the economic status of North Korea, which will emerge rapidly after unification, and the benefits of the unification effect, are greater. To realize the value of minimum living security in North Korea, the minimum living security system should be established first to solve the poverty problem and adapt to the new system in the early days of unification, and among them, the basic pension system in South Korea should be put in a complementary relationship with the National Basic Living Security system to function as minimum living security for the old-age.
