본 연구는 우리나라 어린이집에서 발생한 정서적 학대와 관련된 법원의 판례를 분석하여 정서적 학대를 예방할 수 있는 대책을 마련하는데 그 목적이 있다. 이를 위해 정서적 학대 사건 관련한 1심 판례 10건과 항소심 및 상고심 판례 4건을 심층적으로 분석하였다. 연구 결과 어린이집에서 발생한 정서적 학대 유형은 폭행(손과 발로 머리, 얼굴, 엉덩이 등을 때림), 물건 던짐, 방치, 강제로 음식 먹이기, 손수건과 물티슈로 입 틀어막기, 식사 거르기, 무서운 영상 보여주기 등 다양한 형태의 정서적 학대가 나타났다. 그리고 판례의 주요 쟁점 사안은 위법성조각사유로서의 정당행위 여부, 양벌규정의 적용 여부로 나타났다. 이러한 연구 결과를 바탕으로 어린이집의 정서적 학대 예방을 위한 대책을 제시하였다.
