이 연구는 가출 및 성매매를 경험한 아동・청소년을 둘러싼 환경과 그들의 욕구에 대한 분석을 통해 도출한 아동・청소년 성매매 유입 및 재유입 방지 대책과 아동・청소년 성매매 피해자 지원 인프라의 차별화 및 위기청소년 지원 인프라와의 연계방안 마련을 통한 아동・청소년 피해자 지원 강화 대책, 성매수자의 재범방지 정책에 대한 분석을 통해 도출한 아동・청소년 대상 성매수자 대책 등을 모색함으로써 아동・청소년 대상 성매매 예방 및
피해지원 대책을 제안하는 것을 연구목적으로 한다. 이러한 연구목적 달성을 위한 연구방법으로써 전문가 의견조사(예비조사 9명, 설문조사 505명)와 면접조사(심층면접 40명, 집단면접 14명)를 실시했다.
연구의 주요결과는 다음과 같다. 전문가 의견조사 결과, 가정폭력과 성폭력 피해경험이 아동청소년의 성매매와 관련이 많은 것으로 나타났다. 특히 이런 경험을 가진 아동청소년은 그렇지 않은 청소년보다 자존감이 낮고 치료도 오래 걸리며 사회복귀를 위한 지지체계가 더 열악하다. 가출 후 생존을 위해 학교를 그만두고 성매매로 유입되는 것이 일반적인 경로이고, 최근에는 스마트폰 앱을 통한 조건만남이 많아지고 있다. 성매매의 변화된 특성은 성매매 청소년의 저연령화, 죄의식의 약화, 성매매의 조직화 경향, 가출팸, 또래포주의 등장을 들 수 있다. 또한 성매수자에 대한 보다 강력한 처벌을 요구하고 있고, 교육강화와 지속적인 보호관찰이 필요하다고 보고 있다.
면접조사 결과, 아동・청소년 성매매 동기는 가출로 인한 빈곤과 생계비 마련이 가장 큰 요인이고, 성매매 유입 경로는 인터넷 또는 스마트폰 어플을 통한 조건만남이 가장 많았다. 성매매 결정은 가출 후 또래 포주나 성인 남성이 피해 아동・청소년을 강제로 협박하고 폭행하여 비자발적으로 이루어진 경우가 많았지만, 성매매 결정이 외부의 강제나 폭력에 의한 것이 아닌 경우에도 실질적으로 돈을 벌기 어려운 상황에서 가출 후 먹고 마실 것을 구하기 위해 어쩔 수 없이 선택한 ‘생계형 성매매’라고 볼 수 있다. 또한 비록 스스로 자발적인 성매매라고 인식하는 경우에도 실제로는 ‘비자발적인’ 성매매인 경우가 많았다. 성매매 이후의 신체적・심리적 문제에 대해서는 임신이나 성병에 대한 두려움을 갖고 있는 것으로 나타났다.
이러한 연구결과, 다음과 같은 정책이 제안되었다. 첫째, 아동・청소년 성매매 유입 및 재유입 방지 대책으로 성매매 원인별 유입방지전략 차별화, 가정폭력 방지교육 등 부모교육 실시, 성교육 및 성평등교육 확대, 스마트폰 성매매 대책 수립, 아동・청소년 성매매의 심각성에 대한 인식도 제고, 학교내 상담사 및 복지사 역할 활성화, 가출팸 감독 및 관리 강화, 성매매 이전의 1차 예방: 초기 가출 예방 및 왜곡된 성인식 개선, 성매매 이전/이후의 2차 예방 강화: 초기 성매매 선별・평가 작업 강화, 성매매 이후의 3차 예방: 성매매 재유입 억제방안 강화 등이 필요하다.
둘째, 아동・청소년피해자 지원 강화 대책으로 성매매 피해청소년의 다양한 특성을 고려한 피해지원 시스템 구축, 성매매 피해 청소년을 위한 취업・인문교육 활성화, 성매매 청소년을 피해자로 보는 인식도 제고, 범죄피해자로서의 가출청소년 보호방안 마련, 사례별 조사분석과 지원, 가출청소년 이용업소와의 협력활동 강화, 가출청소년쉼터의 다양화, 성매매 피해 아동・청소년 지원기관의 협력체계 구축, 아동・청소년보호 정책으로서의 정체성강화, 아동・청소년 성매매 업무 체계 일원화, 인터넷 성매매파악을 위한 전담형사 사법수사팀의 구축, 아동청소년 성매매 통계자료 구축, 체계적인 사례관리 등이 필요하다.
셋째, 아동・청소년 대상 성매수자 대책으로 성매매 예방교육의 강화, 비자발적 성매매 아동・청소년 성구매자의 신고유인책 마련, 비자발적 성매매 아동・청소년에 대한 성구매자의 처벌강화, 특정 사회봉사명령의 부과, 성매수자에 대한 강력한 처벌과 단속 등이 필요하다.

This study aims to suggest measures for Children and Youths prostitution prevention and support for victims by seeking measures for preventing Children and Youths prostitution from occurring and recurring drawn through analysis of the environments surrounding Children and Youths who had run away from home and experienced prostitution and their needs; measures for reinforcing support for Children and Youths victims through differentiation of the infrastructure required to support Children and Youths victims of prostitution and planning of linking with the infrastructure for support for adolescents in crisis; and measures for clients of Children and Youths prostitution drawn through analysis of policies on prevention of recidivism of prostitution clients. The methodologies employed to attain the above purposes include expert survey (preliminary survey with nine respondents and main survey with 505 respondents) and interviews (in-depth interviews with 40 interviewees and group interview with 14 interviewees).
The major findings of the study are as follows. The results of the expert survey show that Children and Youths prostitution is much related with the experience of damage from domestic violence and sexual violence. In particular, Children and Youths with such experiences tend to have lower self-esteem than those without, require longer time until they recover from damage, and have a poorer supportive system required to return to society. The most common path to their prostitution is to run away from home and quit school and start prostitution for survival. More recently, prostitution via smartphone applications is spreading. The recent prostitution is characterized by the younger age of Children and Youths prostitutes and less sense of guilt, systematization of prostitution, and the appearance of runaway Children and Youths families and “peer” pimps. There is also demand for tightening penalties against prostitution clients, reinforcing education and conducting continual probation.
According to the results of the interviews, the biggest motive of Children and Youths prostitution is the poverty resulting from leaving home and the need to earn living expenses. As to the path to prostitution, prostitution via the Internet or smartphone applications represented the highest proportion. In many cases, these young prostitutes decided to engage in prostitution involuntarily due to threats or violence by peer pimps or male adults, and even when there was no such threat or violence when they decided to engage in prostitution, their prostitution is deemed as ”prostitution for living” unavoidable to get food after they have run away from home without any preparation to earn money. In many cases, therefore, these Children and Youths are performing “involuntary” prostitution even when they think they are doing it voluntarily. As to physical and psychological problems after prostitution, they turned out to have fears of pregnancy or STDs.
Based on these findings, the following policy has been suggested. First, the suggested measures for preventing Children and Youths prostitution from occurring and recurring include the differentiation of prostitution prevention strategies by cause; conducting of parental education such as education on prevention of domestic violence; expansion of sex education and gender equality education; establishment of measures for prostitution via smartphone applications; improvement of recognition of the seriousness of Children and Youths prostitution; vitalization of the role of counselors and social workers in school; reinforcement of the supervision and control of runaway Children and Youths families; and reinforcement of primary prevention before prostitution (prevention of Children and Youths from running away from home and improvement of distorted perception of sex), reinforcement of secondary prevention before and after prostitution (reinforcement of early screening and evaluation of prostitution), and tertiary prevention after prostitution (reinforcement of measures for keeping prostitution from recurring).
Second, the suggested measures for reinforcing support for Children and Youths victims include the establishment of victim support systems considering diverse characteristics of Children and Youths victims of prostitution; vitalization of job training and humanities education for Children and Youths victims of prostitution; improvement of the problem of recognizing Children and Youths prostitutes as victims; establishment of measures for protecting runaway Children and Youths from being victimized by crimes; case investigation analysis and support; reinforcement of cooperative activities with commercial premises used by runaway Children and Youths; diversification of shelters for runaway Children and Youths; establishment of cooperative systems with institutions supporting victims of Children and Youths prostitution; reinforcement of the identity of Children and Youths as a Children and Youths protection policy; unification of the work system for addressing the problem of Children and Youths prostitution; establishment of an exclusive police investigation team for investigation of prostitution via the Internet; establishment of statistical data on Children and Youths prostitution; and systematic case management.
Third, the suggested measures for clients of Children and Youths prostitution include the reinforcement of education to prevent them from using prostitution; establishment of measures to encourage a report to involuntary Children and Youths prostitution clients; tightening of penalties against clients of involuntary Children and Youths prostitutes; ordering of certain community services; and punishing and cracking down on prostitution clients.
