이 연구의 목적은 WTO 규정의 틀 안에서 회원국 수준에서 그 농업보조 이행결과를 점검하고, 농업보조와 관련하여 실제로 제기된 분쟁사례를 종합하여 분석한 후 그 시사점을 도출하는 데 있다. 또한, 2013년 5월 현재 논의되고 있는 EU 농정(CAP) 개혁안과 미국의 농업법(Farm Bill) 개정안 가운데 농업보조 관련 제안이 WTO 규정에 부합할 것인지에 관해 논의하고자 한다.

먼저, 2010~12년에 총 10회에 걸쳐 WTO 농업위원회가 회원국의 농업보조 관련 농업협정 이행사항을 점검하였는데, 총 698건의 질의·응답이 이루어졌다. 허용보조(green box), 감축대상보조(AMS), 최소허용보조(de minimis), 블루박스(blue box) 순으로 논의가 많았는데, 허용보조가 50% 이상을 차지하였다. 이처럼 허용보조에 관한 논의가 많은 것은 보조 상한이나 감축이 없는 보조이고, 통보된 내용만으로 그 합법성을 판단하기 어렵기 때문이다.
한국과 관련한 논의는 한국이 허용보조로 통보한 논에 대한 고정 직접지불(fixed payment scheme for paddy fields)과 쌀 공공비축제도(public stockholding program)에 집중되었다. 이는 직접지불의 목표가격 상향조정과 같은 조치 시 그 기준연도 설정, 가격 및 무역효과의 최소화, 대상 농지의 이용 등과 같은 허용보조 요건을 명확하게 충족하는 게 중요할 것임을 시사한다.
1995년 이래 농업보조와 관련된 WTO 분쟁은 총 6건으로, ① EU-설탕, ② 캐나다-유제품, ③ 미국-면화, ④ 중국-브랜드상품, ⑤ 미국-옥수수, ⑥ 한국-소고기 등이다. 이 가운데 특히 EU-설탕과 캐나다-유제품 분쟁에 관한 WTO 평결은 기존의 WTO 규범체제 아래 국내보조와 수출보조가 독립적으로 규율되고 있으나, 국내보조가 수출보조와 실제로 연계되어 무역왜곡효과를 초래할 수 있다는 점을 부각시켰다는 점에서 중요한 시사점을 던져 준다.
생산 쿼터(EU-설탕)나 수익통합조치(캐나다-유제품) 아래 발생하는, 이른바 교차보조(cross-subsidization)가 중요한 이유는 허용보조로 통보되고 있는 한국을 비롯한 많은 회원국들의 비연계 직접지불(decoupled direct payment)이 사전에 정해진 물량에 대해 보조를 받는 형태이므로 생산 및 무역왜곡을 지닌다는점을 밝히고 있기 때문이다. 비연계 직접지불의 요건으로 해당 농지에 채소와 과실을 재배하지 못하도록 제한하는 것은 농지사용에 관한 제약을 부과하는 것이므로 허용보조 규정에 위반된다고 평결한 미국-면화 분쟁사건은 2013년 미국 농업법 개정의 중요한 결정 요인으로 작용하고 있다. EU는 설탕분쟁에서 패소한 결과를 반영하여 2006년 설탕개혁을 단행하였다. 이 개혁조치는 생산 쿼터의 점진적 축소, ACP 국가로부터 수입된 물량의 재수출과 쿼터 초과 물량의 수출을 수출보조 산출에 포함, 공공 수매제 폐지를 통해 최저가격 보장 배제, 2015년 10월까지 생산 쿼터 폐지 등이 포함되어 있다.
2011년 11월에 EU 집행위원회는 2014~20년에 이행될 CAP 개혁안을 제안 하여 2013년 5월 현재 이에 관한 논의가 진행되고 있는데, 이번 개혁안 결정 과정의 특징은 이전과 달리 유럽의회도 의사결정에 참여한다는 것이다. WTO 국내보조 규율 측면에서 살펴보면, 개혁안이 비연계 직접지불로서 제시한 기본 보조(basic payment)와 환경요소(green component)의 경우 ① 왜곡효과가 작지만 실증적으로 유의하다는 점, ② 해당 농지가 농업생산에 적절하게 유지되어야 한다는 요건 등의 상호준수 요건(cross compliance)이 허용보조 자격과 충돌 할 수 있다는 지적된다.
특히 위 ②의 농지관리 요건은, 미국 면화 분쟁사건에서 확인하였듯이, 보조의 자격이 기준기간 이후의 생산 또는 생산 투입재(농지)의 사용에 관한 규제에 해당하므로 WTO의 허용보조 요건을 충족하지 못할 수 있다고 판단된다.
환경보조가 농업협정 부속서2(허용보조 규정) 제12항의 환경 직접지불로 분류될 수도 없는데, 이는 환경조치에 따른 추가 비용이나 소득 손실분에 한정하여 보조하는 게 WTO 규정이기 때문이다. 이 밖에도 직접지불 수혜자의 자격을“실제 농업인(active farmers)”으로 규정한 것도 허용보조 규정에 부합되지 않을 가능성이 있다.
한편, 미국에서는 2012년에 제안된 상·하원의 농업법안에서 WTO에서의 규범 혹은 분쟁사례나 현재 진행 중인 DDA 농업협상과 연관되는 부문은 국내보조 중 면화보조, GSM-102, 식량원조, 바이오에너지 등이라 할 수 있는데, 대체로 종전의 보호정책에서 크게 벗어나지 않고 있기 때문에 WTO 체제에서 미국은 수세적인 입장을 벗어나기 어려울 것으로 예상된다.
국내보조와 관련하여 2012년 상·하원 농업법안은 2008년 농업법의 CCP와 ACRE를 폐지하는 대신 개념적으로는 동일한 가격보장과 수입보장 농가지원 프로그램을 채택하였으며, 최저가격 보장제도인 융자단가제도는 계속 유지되고, 작물보험정책은 오히려 강화되었다.
브라질과의 면화분쟁에서 패소한 면화에 대한 보조금을 개혁하기 위하여 미국은 면화를 품목별 지원정책(Title I)에서 제외시키고 Stacked Income Protection Plan(STAX)으로 불리우는 새로운 작물보험정책(Title XI)의 대상품목으로 제안 하였다. STAX은 기본적으로 현행 지역(county) 수입보험정책인 GRIP(Group Revenue Insurance Policy)의 수정된 형태인데 STAX은 농장 수준이 아닌 지역 수준의 정보를 이용하여 기대된 지역평균수입의 10~30% 사이에 해당하는 경미한 손실을 보상하는 제도이다. 양국 간 면화 분쟁을 확정적으로 해결하기 위해서는 미국이 자국의 농가에 대해 지원하는 보조금 제도가 순수 수출에 미치는 영향을 거의 또는 상당 부분 감소시키는 것을 요구하고 있으며 가격보전직불, 마케팅융자직불이 반드시 철폐 또는 수정될 것을 요구하고 있는데 STAX에 대해 브라질은 면화분쟁 이행 약속 의무 수준에 못 미친다는 불만을 제기하고 있다.
미국의 높은 국내 농업보조금에 대한 국제적 비판의 목소리와 WTO DDA 농업보조금 협상동향을 감안한 일부 개혁이 있었으나 DDA 농업보조금 분야 협상의 쟁점인 품목별 농가지원 프로그램과 작물보험 프로그램은 오히려 강화된 측면이 있다. 특히 국가재정이 부족하여 농업부문에 대해 지원을 거의 하지 못하는 개도국들과 비보조 수출국인 케언즈 그룹들의 불만은 지속될 것으로 보인다.

First, it aims to examine how member countries have implemented their agricultural domestic support under the Agreement on Agriculture, which have been regularly monitored and discussed by the Committee on Agriculture (CoA) in the World Trade Organization (WTO). Second, it is to analyze formal trade dispute cases related to domestic and export subsidies among WTO member countries and derive their implications in terms of policy reforms or directions.
Finally, it is to review on-going reform talks of the Common Agricultural Policy (CAP), the European Union by giving close attention to the policy proposals’ compatibility with the current WTO disciplines.
An examination of the minutes of the CoA meetings reveals that close to 700 questions and replies were made on agricultural subsidies over the 2010-12 period. Among the four major agricultural subsidies, namely Aggregate Measurement of Support (AMS, or Amber Box), Blue Box, de minimis, and Green Box, inquiries about Green Box measures were in the majority. This is partly because these measures are of no ceilings and are not subject to reductions, typically notified with insufficient information.
With respect to Korea’s notifications, the United States, Canada and Australia sought for clarifications on the legitimacy of the fixed payment scheme for paddy fields and public stockholding program for rice as Green Box measures. It is thus important to pay attention to Green Box criteria when the country considers the possibility of increasing target prices for direct payments and specifying land use requirements for the payments.
Since 1995, there have been six dispute cases regarding agricultural subsidies under the Dispute Settlement Body of the WTO. They include EU-Sugar, Canada-Dairy, US-Cotton, China-Brand Products, US-Corn, and Korea-Beef. Among others, WTO rulings on EU-Sugar and Canada-Dairy disputes were substantial and significant because they were on economic grounds of the so-called cross-subsidization effects. The cross-subsidization incidence refers to the case when domestic price subsidies within production quotas (EU-sugar) or revenue pooling mechanisms (Canada-dairy) have spillover effects on or play as export subsidies. If this argument is further generalized, various forms of decoupled direct payments applied to a limited volume of farm production could be challenged as a trade distorting instrument.
The US-Cotton case highlighted that the ban on planting fruits, vegetables and wild rice on base acres disqualifies the US direct payment program as a Green Box measure, because it is to place a restriction on land use. Consequently, the 2013 US Farm Bill is forecast to rectify these payment requirements. Being cast in the sugar case, the EU drafted and implemented the 2006 sugar reform, which was targeted at phasing out production quotas by October 2015, eliminating of public intervention and thus minimum price guarantee and counting re-exports of the imported sugar from the ACP countries and exports of over-quota production (C-sugar) in export subsidies.
The 2013 CAP reform proposals presented reformulated direct payment schemes as the basic payments and the green component. But there is the rise of concern about the eligibility for such payments as decoupled income support under the Annex 2 of the Agreement on Agriculture.
First, there are many empirical evidences that even decoupled payments cause distortion albeit smaller than other types of subsidies. Second, the condition that payments must be tied to “maintained in good agricultural and environmental condition” or cross compliance may render challenge of litigation. By influencing production or farm inputs uses, such cross compliance requirements may create difficulty with the Article 6(d) in Annex 2, which states that payments should not be “related to or based on the factors of production employed in any year after the base period.”
Likewise, the fact that eligibility of payments is limited to “active farmers” seems at risk of the same criterion. Finally, it is noted that the environment component cannot fall into the Article 12 for payments under environmental programs since the payments are not “limited to the extra costs or loss of income involved in complying with the government program.”
In sum, the CAP reform proposals are far from being substantial from the WTO perspectives. Unlike the proposed US Farm Bill, the new direct payments are forecast to be in much the same vein, leaving the current litigation at risk.
The 2008 US Farm Bill expired in Sept. 2012 and was extended 1 year.
The Senate approved its version of a new five-year farm bill on June 10, 2013. But the House failed to pass a House version of the farm bill on June 13, 2013. The Senate bill eliminates program supports for US upland cotton growers and replaces it with a stacked income protection insurance plan, in an effort to finally put to rest a dispute by Brazil against what it says are illegal subsidies to US cotton producers. Also revised to meet Brazil's objections is an upland cotton-marketing loan program. To receive marketing loans, farmers must agree to comply with conservation and wetlands requirements. Similar language is contained in the House version.
