가. 학생미혼모의 학업지속과 지원 요구

가. 학생미혼모의 학업지속과 지원 요구
□ 학생미혼모는 대부분 가족구조 해체를 경험하였으며 경제적으로 어려운 가정환경 속에서 대화 단절 등 가족으로부터 정서적 지지가 충분하지 못한 가운데, 역기능적 가족문화 등으로 참여자의 절반 정도가 임신 이전에 가출경험이 있음.
□ 학교생활은 학교부적응, 낮은 학업성적 등의 문제를 지니고 있는 경우가 많았음. 특히, 교사와 관계가 나빴던 경우 학업중단으로 이어지는 경향이 강했고 임신이전부터 학업중단의 위기를 겪거나 학업이 중단된 사례가 다수 나타남.
□ 학생미혼모는 대부분 예상치 못한 임신을 경험함. 임신 인지 시기가 임신중반 이후였기 때문에 출산 외의 결정을 할 수 없었던 경우가 많음. 출산후의 계획은 학생미혼모가 미성년자이기 때문에 학생 미혼모 부모의 생각이 양육여부결정과정에 가장 중요요인으로 작용함.
□ 학생미혼모는 복교 이후를 염두에 두고 임신사실을 비밀로 유지하거나 소수의 친구들에게만 공유함. 친구의 임신사실을 들은 또래들은 친구를 배려하고 출산결정을 지지함.
□ 현재 임신한 학생이 학업을 중단하지 않기 위한 유일한 방법은 대안위탁학교로의 이적임. 그러나 대안위탁학교로 이적하는 절차상 학교에 임신사실을 알릴 수밖에 없고 학교는 학교 명예실추를 이유로 학생의 임신사실을 달가워하지 않으며 이적 절차에 비협조적인 모습을 보임. 소문나지 않게 이적할 것을 학생에게 종용하고 최대한 임신한 사실을 친구와 주변에 들키지 않게 노력하도록 요구함. 학교의 이러한 태도는 임신에 따른 퇴학에 두려움을 가진 나머지 학생이 학교나 교사와 상의할 의지조차 상실한 채 스스로 학교를 그만두게 함.
□ 위탁형 대안교육기관으로 이적한 학생 미혼모들의 대안교육기관에서 교육 경험을 보면,
○ 대안교육기관의 학업유지 기능, 소수 맞춤형 수업 및 학업 흥미도 증가, 일반학교보다 자유로운 분위기 등에 만족함. 또한 대안교육기관은 ‘희망과 가능성,’ ‘반성과 각성의 공간’으로 의미화 됨.
○ 원적학교보다 낮은 수업수준, 임신부와 양육미혼모의 상황을 고려하지 않은 환경 등에 불만을 표현함.
□ 대안교육기관에서의 위탁기간이 종료되어 원적학교로 복교하려거나 상급학교로 진학하는 데에도 상당한 어려움을 경험함. 학교가 학생의 임신 및 출산사실을 인지하고 복교와 진학을 거부한 경우가 있었으며 학생들은 복교에 성공하더라도 지체된 학습 진도, 자녀 양육 병행의 어려움을 겪음.
○ 복교를 망설이게 되는 경우 학교에서의 소문, 통제와 규칙 중심의 학교생활에의 적응, 대안교육기관보다 난이도가 높은 수업수준, 학교와 친구들의 특별한 시선과 관심을 우려함. 양육모의 복교나 진학을 원천적으로 봉쇄를 하는 학교도 있는 것으로 드러남.
□ 학업중단상태였던 미혼모는 검정고시를 통해 학업을 지속함.
○ 고졸 학력은 자녀를 양육하고 경제활동을 하기 위한 최소한의 조건으로 여겨짐.
○ 원적교에 복학한 후 대안교육기관으로 이적하려 해도 부모의 동의를 필요로 하기 때문에 부모와 연락이 되지 않는 경우 불가능함.
□ 학생 미혼모들은 임신한 학생에 대한 부당한 자퇴권유 금지, 임신 전과 똑 같은 시선으로 봐주기, 양육미혼모에 대한 배려를 원함. 대안교육기관의 유지 및 확대, 복교 이후를 고려한 교육수준 및 과목의 개선, 학업병행이 가능할 수 있는 탁아서비스 지원, 임산부에 대한 배려를 원함. 육아현실에 맞는 경제적 지원, 학업병행이 가능할 수 있는 제반서비스의 지원, 학생 미혼모를 위한 출산휴가제도 도입을 원함.
나. 시도 교육청의 학생 미혼모 학습권 보장 정책 추진 실태 분석
□ 17개 교육청 중 15개 교육청이 이성교제 관련 학칙 개정을 권고하였으나 일선 학교들은 여전히 학칙을 개정하지 않고 있는 것으로 드러남.
○ 서울, 부산, 광주, 경북, 전북 5개 지역 중등학교를 전수 조사한 결과, 5개지역 786개 고등학교 중에서 절반 이상의 학교가 이성교제 관련 처벌규정을 두고 있음.
○ 고등학교의 경우 과반에 가까운 48.1%의 학교에서 이성교제와 관련하여 가장 처벌수위가 높은 퇴학을 규정함.
○ 이성교제관련 처벌조항을 갖고 있는 학교비율이 높은 부산교육청, 서울교육청, 경북교육청의 경우 여학교에 이성교제관련 조항이 있는 비율이 남학교에 비해 월등히 높아 부산교육청 79.4%, 경북교육청 73.3%, 서울교육청 64.4%에 이름.
□ 2013년에 위탁교육을 받은 학생 미혼모는 총 68명에 불과함.
○ 서울과 경기교육청이 가장 많아 연간 15명이고 강원교육청 10명, 인천 교육청 8명, 제주교육청 6명의 순임. 부산교육청과 같이, 학생 미혼모가 전혀 없었던 교육청도 5개에 달함.
□ 17개 교육청 중 예산을 지원한 교육청은 총 12개 교육청이며 12개 교육청의 위탁교육기관 지원 예산은 2013년 34,905만원에서 2014년 32,578만원으로 5.3% 감소함.
○ 12개 교육청의 평균 지원 예산은 2013년 2,909만원에서 2014년에는 2,715만원으로 감소함.
○ 2013년에 위탁교육생이 전혀 없어 예산을 지원하지 않았던 교육청의 경우 2014년에도 예산을 배정하지 않아 사실상 미혼모 위탁교육기관 운영의지가 없어 보임.
○ 위탁교육기관 지원 예산은 강사료 및 교재비 등 보통교과와 특성화 프로그램 운영을 위한 것으로, 교육청 대부분이 위탁교육기관을 운영하고 있는 미혼모시설의 시설비 및 직원 인건비에 대한 예산 지원은 하지 않음.
□ 위탁교육기관 운영상의 어려움은 위탁생 발굴의 어려움(7곳), 예산 지원 부족이나 교육과정 운영 등(5곳), 원적학교 복교 후 학교적응 문제(2곳) 등으로 나타남.
□ 전체의 절반에 달하는 교육청에서 관할 지역이 아닌 타 지역 학생 미혼모의 위탁교육 문제에 직면하고 있으나, 교육자치단체별로 대안교육기관이 운용되고 있어 학생 미혼모 정책담당자의 선의에 의존하는 방식 외에는 문제해결 방법이 없음.
□ 미혼모 위탁형 대안교육기관의 홍보 방식은 대부분(82.4%)이 관련 공문시행에 의존함. 3개 교육청은 미혼모 위탁교육기관 운영에 대한 공문도 시행하고 있지 않음.
○ 교사 연수 및 연찬회를 통해 미혼모 위탁교육기관을 홍보하는 교육청도 절반에도 못 미침(41.2%). 위기청소년들이 상담 및 지원 서비스를 받는 청소년상담기관 등에 위탁교육기관에 정보를 제공하는 교육청은 5곳 (29.4%)에 불과함.
다. 위탁형 대안교육기관의 학생 미혼모 학습권 보장 실태 분석
□ 위탁교육기관을 운영하고 있는 미혼모자시설 15개소에 최근 3년간 입소한 미혼모는 3,379명으로, 24.4%인 826명이 중등학령기 미혼모로 나타남. 이중 중등학교 재학생은 286명으로 34.6%이며 나머지 65.4%의 미혼모는 중퇴 또는 졸업 후 진학하지 않은 경우임.
○ 중등학교 재학 미혼모 중 68.5%인 196명만이 위탁교육에 참여하였으며, 31.5%는 위탁교육대상임에도 위탁교육을 받지 않음.
□ 2015년 7월부터 입양기관에서 운영되는 미혼모자시설이 폐쇄됨에 따라 18개 위탁교육기관 중 7개 위탁교육기관이 폐쇄될 위기에 봉착함.
○ 입양기관에서 운영하는 미혼모자시설에 설치된 위탁교육기관에서 최근 3년간 위탁교육을 받은 미혼모는 88명으로 전체 18개 위탁교육기관에서 교육을 받은 미혼모 196명의 44.9%를 차지함.
□ 교육청간 행정적 문제 혹은 전학의 어려움으로 타 지역 위탁교육의뢰가 원활하지 못하며 위탁형 대안교육기관에 대한 홍보 역시 부진한 상태임.
□ 위탁교육기간은 평균 7.5개월이며 6개월 미만인 기관이 8개(44.4%)로 가장 비중이 크고 6~12개월이 6개(33.3%)이며, 12~18개월과 18개월 이상이 각각 2개 기관으로 나타남.
○ 18개 기관 중 12개 기관에서 위탁교육기관 종료 후 학생이 계속 남기를 희망하는 사례가 있었으며 위탁지속을 희망하는 가장 큰 이유(58.3%)가 자녀의 양육문제임.
□ 복교 시 학생들이 겪는 어려움으로는 친구들 사이의 임신이나 출산 관련소문에 대한 우려(77.8%), 학교 또는 학교장의 배타적인 태도(61.1%)로 나타남. 위탁교육을 희망하였으나, 위탁교육을 받지 못한 사례가 있는 기관은 18개 기관 중 절반인 9개 기관에 달함.
□ 교육청 학사관련 지침의 부재, 일선 학교의 미비한 행정적 협조, 제도의 경직적 운영, 미혼모 위탁기관이 홍보의 부진 등으로 어려움을 겪고 있음.
□ 예산부족으로 인해 강사료책정 및 강사수급과 강사의 질 확보에 어려움을 겪고 있으며 학교급 및 학년 분리 교육이 불가함. 또한 검정고시반과의 병행교육, 정규교과목 5개 중심의 교육이 진행되고 기관에 따라 정규교과 시간과 대안교과 수 및 시간 편차가 큼. 특성화계 고등학교재학생의 경우 위탁교육기관에서 전공이나 특기를 고려한 교육이 불가능한 경우도 발생
□ 예산 지원 항목은 인건비 지원이 10개 기관(71.4%)로 가장 많고, 그 외 교재비 및 프로그램 운영비 지원이 9개 기관(64.3%), 운영비가 7개 기관(50.0%) 순으로 나타남.
○ 64.7%의 기관에서 현재의 강사료 수준이 적정하지 않다고 답함. 정규교과 강사들의 시간당 강사료는 평균 2.3만원이며 가장 높은 강사료는 5만원인 반면, 강사료를 전혀 지급해주지 못하고 오직 자원봉사로만 운영하고 있는 기관도 3개(16.7%)임.
□ 예산지원 요구와 관련하여 탁아모 및 보육교사 비용(81.8%), 행정인건비(36.4%)가 가장 시급하며 상담비, 교사인건비, 프로그램 운영비(각각 18.2%)이외에도 산후조리비용, 보육교사인건비 등이 필요한 것으로 나타남.
□ 18개 기관 중 17개 기관이 검정고시반을 운영하며 최근 3년간 위탁교육기관에서의 검정고시 참여 미혼모 인원은 총226명으로 위탁교육생(196명) 보다 많음. 중학교 과정 51명, 고등학교 과정 175명이며 3년간 중학교 과정 참여인원이 68% 감소함.
○ 재정 문제 및 검정고시반 학생인원 미달로 3개 기관이 검정고시반과 위탁교육기관을 통합 운영하고 있음. 검정고시반을 별도로 운영하는 경우, 10개 기관은 시설 내 별도의 분리수업을, 5개 기관은 외부기관에 위탁하고 있음.
라. 외국의 십대 미혼모 학습권 보장 정책 사례
□ 미국은 1972년에 교육개정법 9편(TitleⅨ)에 근거하여 미국의 모든 교육프로그램 및 활동에서 그 어떤 종류의 성차별도 금지하도록 규정하였으며 임신 및 출산으로 인해 교육에서 배제되어 왔던 십대여성들에 대한 학습권을 법적으로 보장하였음. TitleⅨ의 발효 이후 다양한 정책을 통해 임신한 여학생의 학교 중도 탈락율이 급속하게 감소함.
○ 연방정부 차원의 프로그램인 TANF와 PAF의 경우 학생 미혼모의 학업 지속을 위해 주정부를 통해 학생 미혼모에게 수급(TANF), 맞춤형 포괄적 서비스(PAF) 등을 지원함.
○ 뉴욕 LYFE 파일럿 프로그램, 코네티컷 주의 Student and Family Services 등은 학교기반형 보육지원정책으로 학생 미혼모가 학교에 등교할 때 자녀도 함께 등교하여 교내 보육시설에서 돌봄서비스를 받음.
○ 가정기반 프로그램을 통해 1:1로 지원하거나 PACT등의 프로그램으로 교육청을 통해 사례관리를 실시하고 있음. 개인적, 사회적, 경제적, 의료적 어려움 등 다양한 문제에서 도움을 받을 수 있도록 포괄적이고 다양한 맞춤형 지원과 사례관리를 하고 있음.
□ 영국은 국가차원에서 다양한 정부부처가 학생 미혼모 발생의 구조적 요인, 학업 중단의 요인, 학습 지속의 장애요소 등을 규명하고 정책 실행 후 정책 평가를 통해 피드백을 도출하여 다시 정책 개선에 적용시키고 있음.
○ The Care to Learn programme을 통해 십대모들이 교육 및 훈련과정에 참여 및 재진입할 수 있도록 보육 관련 재정을 지원함. 보육은 학생 미혼모의 학업 지속에 가장 어려운 요인임을 적용한 사례임.
○ 포괄적이면서도 1:1 맞춤형인 서비스를 제공함. ‘the Sure Start Plus’의 경우 십대모에게 금연, 모유수유, 상담서비스, EET 참여/복귀를 돕는 전문 교육 서비스와의 연계를 제공함.
○ 학생 미혼모에게 교육유지수당(EMA, Education Maintenance Allowances)을 지급하여 학생 미혼모의 학습유지를 장려하고 있음.
□ 대만은 학생 미혼모 학습권 보장과 관련하여 유교문화권의 한계를 벗어나 선진적인 법제를 확립함.
○ 법(양성평등교육법 및 양성평등교육법 시행세칙), 관련 교육부 규정(학생 임신 사건 상담 및 처리요점, 고급중학생의 성적 및 시험관리법 등)을 명문화하여 확실한 법적 근거를 두고 있음.
○ 법과 규정의 구체성은 학교현장에 효율적인 가이드라인을 제공할 뿐만 아니라 각 학교가 ‘준법’과 ‘준칙’을 실행할 것을 강력하게 요구함. 특히 학교가 지속적이며 성실하게 법과 규정을 준수하도록 평가와 보고체계, 사례관리 체계를 마련하여 실시함.
○ 대만 교육부가 교육정책과 제도의 전개에 있어서 선진적인 주체로 활약함.
또한 학생 중심적으로 융통성 있게 제반 규정을 운영함.
○ 2008년부터 학생에게도 성인과 동일한 출산휴가제를 도입하여 학생 미혼모가 자기 학년에서 학업을 마칠 수 있음. 대만 노동기본법에서 보장하는 최대 56일의 출산휴가와 2년 이내의 양육 휴가가 주어짐.

Constitution and Basic Educational Law in Korea secure every Korean's right to learn and equal opportunity in education, yet pregnant students in actual school systems are situated in blind spots of education. In Korean society, negative stereotypes of teenage single mothers prevail, and schools have enforced those students to drop out their schools on the basis of student regulation that makes it possible for schools to expel those pregnant students. In 2009, as National Human Rights Commission of the Republic of Korea rules it as discriminative, Ministry of Education and provincial and metropolitan/municipal offices of education takes a measures of securing the student single mothers' right to learn by revising school regulations; for instance, they include current operation of eighteen contract alternative educational institutes for single mothers. But since the government has not checked feasibility of the measure of securing the student single mothers' right to learn, overall research to seek synthetic diagnosis of this measure and search for alternatives is necessary.
As a methodology, this research conducts in-depth interviews with thirty teenage single mothers who have experienced pregnancy and childbirth during their secondary school-age years in order to understand their experiences of staying in schools or dropping out of schools in case they are already dropouts. Also, this research conducts an investigation of the operation condition of eighteen contract alternative schools for single mothers nationwide; it also inspects seventeen provincial and metropolitan/municipal offices of education regarding their taking the measure of securing the student single mothers' right to learn. Moreover, accompanying interviews with expert groups carried out, this study also endeavors to develop ways to secure teenage single mothers' right to learn by exploring policy cases for supporting teenage single mothers in the U.S. the UK, and Taiwan where the pregnancy rate of teens is high.
The result of in-depth interviews shows that most participants tend to have experienced family disorganization and have such problems as runaways and school maladjustment, low academic achievement, etc. due to dysfunctional family culture and economic poverty. Though there are many cases of students' getting pregnant during schooling, there is also significant number of cases of getting pregnant when they are already dropouts. Most student single mothers are forced into a situation in which they cannot find any other measures than giving birth because they often find out their pregnancy after the middle phase of pregnancy.
Currently, the only way for the pregnant students to continue her schooling without dropping out of school is to transfer to contract alternative educational institutes. But the process of transference to the alternative schools cannot help publicizing students' pregnancy, and schools are not very pleased with the fact that their students are pregnant so that they tend to be reluctant to cooperate in this process. Moreover, school sometimes insidiously urges the pregnant students to transfer secretly and not to disclose their pregnancy to other friends or acquaintances. Schools' such negative attitudes forces students, who are afraid of expulsion from schools due to pregnancy and deprived of will to consult with teachers, to quit school.
Those students who have experienced contract alternative educational institutes are satisfied with the institutes because of the fact that the students can continue to learn, they have grown interest in learning due to the tailored teaching for small groups, and the institutes have much freer atmosphere than regular schools. To them, an alternative educational institute signifies “hope and possibility” and “space of self-reflection and epiphany” However, these students point out such drawbacks as the lower level of classes than those of their previous (regular) schools and relatively poor educational environment where the situations of pregnant women and child-rearing single mothers are not considered, etc.; they also experience much difficulties in returning to the schools they were originally enrolled in after getting contract education or in entering advanced schools. Notably, there are cases where school, recognizing the student's pregnancy and childbirth, denies her returning to the original school or entering advanced school; what's more, those who have returned to the schools they were originally enrolled in express difficulties in catching up with the academic schedule, rearing their child and studying at the same time, etc.
The result of investigation of the provincial and metropolitan/municipal offices of education shows that schools do not modify their regulations yet even though fifteen, out of seventeen, offices of education have recommended schools to do so. The result of the total inspection reveals that more than a half of 786 high schools in five areas—Seoul, Busan, Gwangju, Keyongbuk, and Jeonbuk—have regulation of dating and 48.1% of these schools, almost a half of the total, have a regulation of expulsion of pregnant students. Research on contract alternative schools proves that the alternative educational institutes cannot provide classes based on each student's grade or school level because most of these institutes cannot supply enough instructors due to the lack of financial support. Though classes of regular subjects including Korean, English, Math, etc. and classes based on alternative subjects such as parent education are offered, deviation among these institutions is too wide. In terms of administration, some offices of education do not have academic guidelines and they also suffer from such difficulties as lack of advertisement of contract education as well as lack of administrative support from the schools the student single mothers were originally enrolled in.
The result of interviews with field experts and investigation of foreign cases reveal that active and diverse support from regional communities and other schools, improvement of social awareness, comprehensive support system, securing budget, maternity leave policy, etc. are necessary in addition to contract alternative educational institutes. Based on these results from the research, this paper suggests such policy measures as the following in order to secure the student single mothers' right to learn.

- To establish a new clause regarding the absence or leave in relation to pregnancy and childbirth to guidelines for writing students' school record and for management of it regarding
- To create a manual of securing the pregnant students' right to learn and distribute it
○ To mount a publicity campaign to inform the policy on the student single mothers' right to learn
○ To establish comprehensive support system for improving the effectiveness of contract alternative educational institutes
- To appoint, integrate, and operate these institutes as a national policy undertaking
- To secure facilities for maternal and child welfare specialized in adolescents single mothers
- To create an educational environment for student single mothers to do both studying and child-rearing
○ To enforce systemic educational support of contract alternative educational institutes
- To create guidelines of alternative educational programs
- To enforce budget support for enrichment of teaching and learning
- To provide opportunities for the students to get career education and vocational training
- To operate responsively to student mothers’ situations
- To expand targets of contract education
○ To increase teachers' and school community's awareness of the teenage single mothers' right to learn
○ To establish the foundation of local communities for single mothers
○ To improve the effectiveness of sex education in order to prevent unwanted pregnancy
