현재 우리나라의 의료기기법은 의료기기의 대상 사용자를 구분하여 의료기기에 대한 등급 결정, 허가요건이나 유통경로 등에 규제를 차별화하고 있지 않다. 이로 인해 다음과 같은 두 가지 측면에서 개선이 필요한 문제점이 파악되었다.
(1) 의료기기가 일반인에게 규제없이 유통됨으로써 불법의료에 사용되고 있는 점.
(2) 일반인이 사용하는 의료기기에 대한 사용설명서 등이 일반인에게 너무 어렵거나 적절하지 않아서 일반이이 사용할 때에 안전하고 유효한 결과를 얻을 것으로 보증할 수 없다는 점. 유헬스케어의 확산으로 일반인에 의한 의료기
현재 우리나라의 의료기기법은 의료기기의 대상 사용자를 구분하여 의료기기에 대한 등급 결정, 허가요건이나 유통경로 등에 규제를 차별화하고 있지 않다. 이로 인해 다음과 같은 두 가지 측면에서 개선이 필요한 문제점이 파악되었다.
(1) 의료기기가 일반인에게 규제없이 유통됨으로써 불법의료에 사용되고 있는 점.
(2) 일반인이 사용하는 의료기기에 대한 사용설명서 등이 일반인에게 너무 어렵거나 적절하지 않아서 일반이이 사용할 때에 안전하고 유효한 결과를 얻을 것으로 보증할 수 없다는 점. 유헬스케어의 확산으로 일반인에 의한 의료기기 사용이 확대되어가고 있는 추세임을 고려할 때에, 일반인의 안전한 의료기기 사용을 확보하기 위해서 매우 필요함.
이에 대한 개선안을 마련하기 위해서 우선 의료기기 규제제도의 선진국인 미국, 유럽, 일본의 현황을 조사하였다. 해외 제도 선례를 참고하고, 우리 나라의 현재 사회적 필요성과 현재 제도의 장단점, 이해관계자의 수용가능성 등을 종합적으로 고려하여 아래와 같이 제도 개선안이 마련되었다. 개선 내용은 산업체, 학계를 포함되는 전문가 협의회를 통하여 논의되었고, 의견이 수렴되었다.
(1) ‘전문의료기기’와 ‘일반의료기기’의 분류 도입: 전문의료기기는 기기의 사용목적과 사용자 또는 사용시 사용대상의 인체에 미치는 잠재적 위험도를 고려하였을 때에 의료인 또는 의료기사, 안경사가 사용하는 것이 적절하다고 판단하는 의료기기를 말한다. 여기에서 의료인이라 함은 의료법에 따라 의사, 치과의사, 한의사, 조산사, 간호사가 포함된다. 전문의료기기 이외의 것은 모두 일반의료기기이다.
(2) ‘전문의료기기’와 ‘일반의료기기’의 결정: 법규에서 정한 이 두 개 분류 기준을 적용하여 제조자가 품목신고/인증/허가 신청서에 표시하도록 하고, 승인기관은 개별 제품의 사용 목적, 사용자 또는 사용시 사용대상의 인체에 미치는 잠재적 위험도, 개인과 공중보건에 미치는 영향 등을 고려하여 심사한다.
(3) 표시기재 기재 사항의 규제 차별화:
1) 전문의료기기: ① ‘전문의료기기’ 라는 표시, ② ‘의료인, 의료기사, 안경사만 사용할 수 있다.‘는 표시, ③ ‘일반인이 알기 쉬운 사용설명서’ 요건 면제. 전문용어를 사용하여 사용설명서 기재 가능.
2) 일반의료기기: ① ‘일반 의료기기’라는 표시. ② ‘일반인이 알기 쉬운 사용설명서’ 요건 적용. 제조자가 일반인 대상 ‘알기 쉬운 사용설명서’를 개발하여 허가심사시에 제출하고 심사 받음.
(4) 유통 경로의 규제 차별화
1) 전문의료기기: 의료기관 또는 동물병원 개설자만이 취득할 수 있고, 의료인, 의료기사 또는 안경사 만이 사용할 수 있음.
2) 일반의료기기: 의료기관과 일반인 모두 취득 및 사용 가능. 일반의료기기 중 판매업면제 대상 확대.
(5) 광고사전심의 규제 차별화
1) 전문의료기기: 자사 홈페이지에 대해서 광고사전심의 면제.
2) 일반의료기기: 현행 유지.
이러한 제도적 개선 내용을 반영하는 법규 개정안을 아래와 같이 마련되었다.

Korea does not have a system in place to differentiate regulatory requirements for medical devices, such as, determining a class or regulatory pathway for a device, depending on intended user of the device. Because of such current regulation, the following problems have been identified for improvement.
(1) Devices intended to be used by healthcare professionals are being used by unqualified lay persons for illegal medical services
(2) Directions for use provided in insert papers together with products are too difficult, so safe and effective use of medical device is not assured. As more lay persons use medical devices more than every by spread of U-healthcare technology, this is a problem that should be addressed.
To explore ways to improve the situation, we studied how other advance regulatory system deal with those problems. With information collected through such research, we considered a level of needs for improvement in this aspect, experiences with the current system and acceptability of stakeholder together with a team of advisors invited from academia, industry and research group.
As a result, we developed a revision to the current system featuring as follows:
(1) Introduction of a system categorizing ‘professional device’ and ‘general device’: Professional device refers to a product that is used by healthcare professionals in terms of intended use or potential hazard exposed to device users or subjects for whom a device is applied to. Professionals include herein healthcare professionals provided by Medical Service Act (medical doctor, dentist, herbal medicine doctors, midwives, nurses), healthcare technicians or opticians. General devices refer to those devices that are not professional device.
(2) Determination of ‘professional device’ vs. ‘general device’: Manufacturers are required to submit either category in its application for pre-market approval notification or approval. Review organizations consider intended use of the submitted device or users or subjects for whom the device is applied to or potential hazard exposed to individuals or public health and determines the acceptability of such application.
(3) Differentiation in labeling requirements:
1) Professional Device: ① Labeling ‘Professional Device’, ② Labeling ‘This device can be used only by healthcare professionals, healthcare technicians and opticians.’, ③ Exemption from directions for use for lay persons. Can use professional terms in directions for use. 2) General Device: ① Labeling ‘General device’. ② Applied to labeling meeting with requirements for directions for use for lay persons
(4) Differentiation in distribution channel
1) Professional Device: Only medical institutions or veterinary hospitals obtain for use, and only qualified healthcare professionals, healthcare technicians or opticians can use it.
2) General Device: Both medical institutions or veterinary hospitals and lay persons can obtain it for use. It is recommended to expand the number of products exempted from medical device distributor license.
(5) Differentiation of prior review of advertising materials
1) Prescription Device: Exempt from the requirement for prior review of advertising materials posted on the supplier’s homepage.
2) General Device: Remain unchanged.
