◦ 2014년 3월 24일 동법 제10조가 개정됨에 따라 ‘시행중인 법령’ 및 ‘여성의 지위향상과 밀접한 관련이 있는 중앙행정기관 및 지방자치단체의 소관 정책과 공공기관이
수행하는 사업’에 대하여 특정하여 성별영향분석평가를 실시할 수 있도록 규정하고
있음.
◦ 이에 본 연구는 2012년과 2013년에 이어 2014년에는 동법 제10조를 근거로 특정성
별영향분석평가 대상 법령 분야로, ① 헌법, ② 국가공무원, ③ 법원, ④ 민방위·소방, ⑤ 군사, ⑥ 병무, ⑦ 국가보훈, ⑧ 과학·기술, ⑨ 관세, ⑩ 담배·인삼, ⑪ 통화·국채·금융, ⑫ 공업규격·계량, ⑬ 공업소유권, ⑭ 에너지이용·광업, ⑮ 전기·가스, ⑯
수자원·건설업, ⑰ 정보통신, ⑱ 외무 등의 법령 분야를 선정하여 여성정책에 파급
효과가 크거나 성평등이 취약한 분야에 대한 특정성별영향분석평가를 실시하여 구체적인 법령 정비방안 도출 및 개선방안을 마련하고자 함.
◦ 이미 특정성별영향분석평가가 이루어졌으나 최근 제·개정된 ⑲ 사회복지, ⑳ 노동
법령 분야 역시 여성의 지위 향상 및 성평등에 미치는 영향이 매우 크므로, 이에 대한 추가 성별영향분석평가를 실시할 필요가 있음. 그 밖에 대국민공모과제인 아이
돌봄서비스 비용에 대한 특별세액공제, 출생등록 신고제도, 모유수유시설 설치 기준 등의 관련 법 개정안 마련도 필요함.
2. 연구 내용
◦ 상술한 20개 분야별 총 1,558개 법령 및 대국민공모과제 관련 법령(총 3개)을 대상으로 1차 분석평가, 2차 심층분석평가를 실시하여 개정 사항에 대한 관련 통계, 기존 연구결과 등을 통한 구체적인 분석근거를 토대로 현행 법령․개정안 대비표로
구체적인 현행 법령 개선과제를 제시함.

1. Necessity and Purpose of Research
◦ Upon the enactment of The Gender Impact Analysis and Assessment Act on
March 16, 2012, central administrative agencies and local governments have been
conducting gender impact analyses and assessments on newly enacted or revised
bills (Acts, Presidential Decrees, Ordinances of the Prime Minister, Decree-Laws,
Ordinances, and Regulations). However, the current gender impact analyses and
assessments are only subject to bills being newly enacted or revised, causing
limits to analyzing and improving factors of gender inequality in the existing laws
in general.
◦ Upon the revision of Article 10 of the Act on March 24, 2014, it is prescribed
that gender impact analyses and assessments may be conducted on laws in
operation; on specific policies within the scope of a central administrative agency
or a local government that are closely related to improving the status of women;
and on specific projects conducted by public organizations.
◦ In the 2014 research, following the year of 2012 and 2013, based on Article 10
of the Act, the following areas of law have been selected to be analyzed and
assessed for specific gender impact: ① Constitutional Law, ② Government
Officials, ③ Judiciary, ④ Civil Defense․Firefighting, ⑤ Military, ⑥ Military
Affairs, ⑦ Patriots and Veterans Affairs, ⑧ Science․Technology, ⑨ Tariff, ⑩
Tobacco․Ginseng, ⑪ Currency․Government Bonds․Finance, ⑫ Industrial
Standards․Metrics, ⑬ Industrial Property Rights, ⑭ Energy Usage․Mining
Industry, ⑮ Electricity․Gas, ⑯ Water Resources․Construction Industry, ⑰
Information and Communications, and ⑱ Foreign Affairs. The purpose of this
research is to conduct specific gender impact analysis and assessment on areas
that greatly impact policies on women or lack gender equality in order to develop
specific measures for overhauling laws and to come up with measures for
improvement.
◦ As the recently enacted or revised laws of ⑲ Social Welfare and ⑳ Labor areas
greatly impact the status of women and gender equality, additional gender impact
analyses and assessments should be conducted, regardless of the fact that specific
gender impact analysis and assessment on these areas have already been
conducted. In addition, it is imperative to prepare revised bills that are related to
special tax deduction for expenses of child care service that is an item of public
contest, birth registration declaration system, standards on installation of
breastfeeding facilities, etc.
2. Research Content
◦ A total number of 1,558 laws within the 20 areas listed above and additional 3
laws related to the items of public contest were analyzed in two phases of an
initial analysis followed by an in-depth analysis and assessment. As a result, a
comparison chart on current laws and revised laws was created based on statistics
related to the issues of revised laws, previous research results, etc., indicating
specific areas to be improved on current laws.
