▶ 지방자치제도의 역사적 전개
○ 스웨덴 지방자치정부의 성격은 고대시기부터 자연발생적으로 생겼다는데 독특한 특징을 가지고 있음.
○ 지리적이고 환경적인 특징은 중앙집권을 강화시키기보다 지방분권의 형태로 발전할 수밖에 없었고 당시 부락 중심의 마을은 마을 공동사안에 대해서 정규적인 부락회의를 통해 문제를 해결함.

○ 이후 근대화와 산업화를 경험하면서 실용적인 측면에서 인구수와 지역정부의 능력에 따라 많은 코뮌들이 합병되고 재정비되었음.
▶ 스웨덴 지방자치 관련 법제
○ 1930년대 사민당 주도의 복지국가 건설은 과도한 중앙정부역할에 한계를 가져오면서 1982년 헌법 개정을 통해 좀 더 강력한 지방분권을 실현시켜나감.
○ 스웨덴의 유럽화가 진행되면서 1989년 11월부터 스웨덴에 유럽지방자치헌장이 발효됨.

○ 스웨덴은 헌법에 해당하는 스웨덴기본법 중 하나인 정부조직법 제1조에 민주주의를 실현하는 수단으로 대의제와 지방자치를 명시하고 있음.
○ 이 조항을 통해 정부와 지방정부를 차별하지 않고 민주주의 실현수단과 공권력의 집행기관으로 지방정부를 헌법에 명시함으로써 그 위상을 매우 확고히 세우고 있음.
○ 스웨덴 헌법의 비례성의 원칙과 유럽연합의 다층적 거버넌스 관리형태는 스웨덴 지방자치정부의 자율성과 독립성을 더욱 강화시켜주었음.

▶ 스웨덴 지방자치제도의 특색
○ 스웨덴 지방정부의 존립은 헌법에 근거하여 보장받지만 헌법에서 지방자치정부를 규정하는 상세한 규정은 없음.
○ 헌법을 비롯한 스웨덴 국내법들은 국가적 수준에서 목표를 설정하고 틀을 구성하지만 그 목표를 성취하는 상세한 방법에 대해서는 지방자치정부가 할 수 있도록 여지를 남겨놓고 있음.
○ 스웨덴의 정치체제가 탈중앙화되어 권력이 분산되었다 하더라도 모든 권력과 분산은 의회의 승인하이 이루어지고 있음.
○ 지방정부의 규정이나 조례는 법에 위반되지 않는 범위 내에서 만들어짐.
○ 우리 헌법 제117조와 제118조 단 2개의 조문만으로 지방자치를 규정한 제8장을 구성하고 있다는 것에 반해 스웨덴의 경우 정보조직법 제1장 제7조, 제8조, 제7장 제2조, 제7조, 제8장 제1조, 제2조, 제9조, 제10조, 제19조, 제12장 제2조, 제4조, 제6조, 제8조, 제14장 제1조부터 제6조까지, 제15장 제6조, 제12조 등 지방자치에 관한 규정이 산재되어 있음.

○ 스웨덴기본법 중 하나인 정부조직법 제14장 제4조에 의하면 “자치단체는 그 사무의 관리를 위하여 세금을 부과할 수 있다”고 규정하고 있음.

The European Local Autonomy Charter has influenced the establishment of a new Swedish law in 1991. Then in 1991, the New Local Government Act reinforced the modern system of Swedish local government. The core of the Act was the reorganization of administrative areas, and since the enactment of the Act, Sweden has largely consisted of two local autonomous regions, kommun and Lansting.
Based on the law of Commonwealth, Lansting and kommun's roles are clearly distinguished. Landsting's main role is to support public services such as public transportation and public health in Lan and has the authority to impose income taxes to cover operating expenses. kommun covers a wide range of services, including housing, roads, water and waste treatment, schools, public welfare, senior citizens' welfare and child care.

Ⅲ. The main contents of the Swedish Constitution Law

The clause is a very firm position by stipulating local governments in the Constitution as an institution of democratic realization and governmental authority, without discriminating between the government and local government. And the principle of proportionality in the Swedish Constitution and the EU's multilayered governance management have further strengthened the autonomy and independence of Swedish local governments.
