우리나라에서는 의약품 시판 후 안전관리를 위하여 1995년부터 시작된 재심사 제도를 통해 의약품의 유효성과 안전성을 재평가하고 있다. 그러나 2015년 전주기적 의약품 안전관리를 위한 위해성관리계획(risk management plan, 이하 RMP) 제도가 도입되면서 재심사 제도와 RMP의 범위와 역할에 상당 부분 중복이 있다. 이에 본 연구에서는 단계적으로 재심사 제도를 폐지하고 RMP로의 통합을 위한 세부방안을 도출하여 중장기 로드맵을 제시하였다. 더불어, 단계별 장단점 및 파급효과 등을 분석하여 RMP 제도 개선 및 재심사 제도의 폐지에 따른 취약점에 잘 대처할 수 있도록 제안하였다.
또한, 재심사 제도를 통해 우회적으로 보호받던 의약품의 자료 보호를 위하여 새로운 제도의 도입을 위해 국내외 자료보호 제도를 비교 분석 후 개선방안을 도출하였다.
국내외 재심사 제도와 RMP 뿐 아니라 시판 후 안전관리 제도의 현황을 조사하고, 재심사 제도와 RMP의 세부항목을 비교ㆍ분석하였다. 국외 국가 중 일본에서만 재심사 제도를 유지하고 있고, 유럽과 미국에서는 각각 RMP와 위해성 평가 및 완화 전략(Risk Evaluation and Mitigation Strategies, 이하 REMS)을 운영 중이다. 일본의 경우 사용성적조사 시 증례수를 3000례, 600례로 한정하지 않고 의약품 특성과 시장 상황, 환자의 특수성에 따라 증례수를 산출하고 있으며, 이에 대한 별도의 가이드라인을 제시하고 있지는 않다. 또한 시판 후 임상시험 뿐 아니라 시판 후 관찰연구, 데이터베이스 조사방법도 허용하고 있다. 미국의 경우 REMS의 필요성이 인정되는 의약품에 대해 REMS를 시행하게 되고, 위해성/유익성 분석을 통해 일부 종결하기도 한다. 유럽의 경우, ICH E2E를 반영하여 2005년부터 RMP를 시행 중이고 다양한 방법으로 위해성 관리를 시행 중이다. 유럽에서 정기적 최신 안전성 정보 보고(Periodic Safety Utilization Report, 이하 PSUR)은 RMP와 상당 부분 중복이 있지만, 상호 보완적인 특징을 지닌다. 일본 또한 2014년부터 ICH E2E를 기반으로 하여 ‘의약품 안전성 감시 계획’과 ‘위해성 최소화 계획’으로 RMP를 운영 중이다. 국내의 경우 재심사와 RMP 제도의 중복을 확인하였고, 동시에 시판 후 임상시험에서 이상사례 보고양식과 대상 품목에는 서로 차이가 있음을 확인하였다. 자료보호 제도의 경우 미국에서는 21 CFR 314.108을 통해서, 또 유럽에서는 규정(EC) No 726/2004를 통해서 의약품 자료보호 제도를 별도로 규정하고 있다. 반면, 일본에서는 국내와 유사하게 약사법을 기반으로 한 의약품 재심사 제도를 통해 간접적으로 운영하고 있다. 각 국가에서 보장하는 자료 보호 기간은 의약품의 종류와 특성에 따라 모두 다르며, 미국과 유럽의 경우 일정 기간동안 판매허가의 신청 자체를 금지함으로써 자료보호 기간 종료 이후에도 서류 제출과 심사에 걸리는 시간까지도 간접적으로 보호하고 있다.
국내외 제도의 비교ㆍ분석과 협의체 회의, 워크샵 논의 등을 바탕으로 단계별 로드맵을 제안한 결과, 1단계에서는 재심사 제도 내 시판 후 조사에서 증례수 3000례를 폐지하고 RMP와 이상사례 보고양식 등의 중복을 해소하는 것을 제안하였다. 2단계에서는 RMP를 약사법, 총리령으로 상향 입법화하여 법적 근거를 명확화할 것을 제안하였다. 또한, RMP 제출시기 및 절차를 개선하며 이행 완료의 근거를 마련하고, RMP 이행 완료 후에도 추가 안전성 관리를 위한 PSUR의 별도 지정 근거를 마련할 것을 제안하였다. 더불어 RMP와 재심사 제도의 대상을 통일하는 것을 제안하였다. 3단계에서는 재심사 제도의 법적 근거 삭제 및 RMP로의 완전한 통합과 재심사 제도 폐지로 인해 공백이 발생할 수 있는 자료보호 제도의 별도 신설을 제안하였다. 또한 시판 초기에 시판직후집중모니터링 제도의 도입을 제안하여, 시기별로 안전성 관리를 차등화하여 효율성을 높이도록 하였다. 별도의 자료보호 제도는 약사법 내에, 세부 운영 방법은 총리령 별표로 신설할 것을 제안하였다. 이때 자유무역협정(Free Trade Agreement, FTA)과 같은 국제 통상관련 협정뿐만 아니라 지식재산 기본법과 독점규제 및 공정거래에 관한 법률 등의 국내 타 법령도 고려해야 한다.
본 연구에서는 단계별 로드맵을 제안하여 제도적 측면과 업계 측면에서 기대효과를 분석하였다. 제도적 측면에서는 단계별로 행정 효율 향상, RMP 제도의 법적 근거 명확화를 통해 행정 예측 가능성 재고, 의약품 시판 후 안전관리 제도의 일원화 및 국제 조화와의 부합을 기대할 수 있다. 업계 측면에서는 단계적으로 민원 만족도 향상, RMP 제도 운영의 명확화 및 행정 예측 가능성 재고, 단일화된 의약품 안전성 집중관리를 기대할 수 있다. 단계별 로드맵 제안을 통해 갑작스러운 제도 변화로 인한 혼란을 최소화하도록 노력하였으나, 재심사 제도의 최종 종료시점까지 상당한 기간이 필요하므로 상당한 주의를 요한다. 또한 단계별 법 개정절차가 용이하지 않을 수 있으므로, RMP 상향입법과 재심사 제도 폐지를 위한 법 개정을 동시에 추진할 가능성을 열어두고 준비할 필요가 있다. 시판 후 의약품 안전관리 제도 일원화를 통해서 보다 효율적이고 심도있는 의약품 안전관리가 이루어지길 기대할 수 있다.

In Korea, the efficacy and safety of drugs are being reevaluated through a re-examination system that began in 1995 for safety management after drug approval. However, with the introduction of risk management plan (RMP) system for the entire lifecycle of safety management in 2015, there is a considerable overlap between the scope and the role of re-examination system and RMP. Therefore, in this study, a mid- to long-term roadmap was proposed by abolishing the re-examination system in stages and drawing up detailed plans for integration into RMP. In addition, by analyzing the strengths and weaknesses considering the effects of each stage, we proposed improved RMP system to cope with the weaknesses caused by the abolition of the re-examination system. In order to introduce a new system to protect the data of drugs that were indirectly protected through the re-examination system, the domestic and international data protection systems were compared and analyzed, and improvement measures were drawn up.
In addition to the domestic and international re-examination system and RMP, the status of post-marketing safety management system was investigated, and detailed items of the re-examination system and RMP were compared and analyzed. Among foreign countries, only Japan maintains a re-examination system, and in Europe and the United States, RMP and Risk Evaluation and Mitigation Strategies (REMS) are being operated respectively. In the case of Japan, the number of cases is not limited to 3,000 or 600 cases, but the number of cases is calculated based on the characteristics of the drug and patients, and market conditions. However, no separate guidelines are provided. Post-marketing observational studies and database investigation as well as post-marketing clinical trials are also allowed. In the U.S., REMS is implemented for drugs that are recognized for the need, and some are terminated through risk/benefit analysis. In Europe, RMP has been in place since 2005, reflecting ICH E2E, and risk management is being implemented in various ways. Periodic Safety Utilization Report (PSUR) in Europe has a significant overlap with RMP, but are complementary. Japan has also been operating RMP based on ICH E2E since 2014 as a “pharmaceutical safety monitoring plan” and a “risk minimization plan”. In Korea, there was a duplication between the re-examination and RMP system, and at the same time, there was a difference between the reporting form of adverse events and the target items in the post-marketing clinical trial. For data protection schemes, a separate drug data protection scheme is provided in the United States through 21 CFR 314.108 and in Europe through Regulation (EC) No 726/2004. On the other hand, similar to Korea, Japan operates data protection indirectly through a drug re-examination system based on the Pharmaceutical Affairs Act. The data protection period guaranteed by each country varies depending on the type and characteristics of drugs, and the United States and Europe indirectly protect the time required to submit and review documents even after the end of the data protection period by prohibiting the application for a certain period of time.
As a result of proposing a step-by-step roadmap based on the comparison and analysis of domestic and overseas systems, conference meetings, workshop discussions, etc., we proposed the abolition of 3,000 cases in post-marketing surveys within the re-examination system and the elimination of duplication between RMP and abnormal case reporting forms in the first stage. In the second stage, it was proposed to clarify the legal basis while upgrading the RMP to the Pharmaceutical Affairs Act and Prime Minister Ordinance. It was also proposed to improve the timing and procedures for submitting the RMP, laying the basis for completion of the implementation, and to provide a separate basis for designation of PSURs for additional safety management even after the completion of the RMP implementation. In addition, it was proposed to unify the subjects of the RMP and re-examination system. The third phase proposed to delete the legal basis of the re-examination system, completely integrate it into the RMP, and establish a separate data protection system that could result in gaps due to the abolition of the re-examination system. In addition, it was proposed to introduce an intensive monitoring system immediately after marketing at the beginning of the market to increase efficiency by differentiated safety management by period. Separate data protection system was proposed to be established within the Pharmaceutical Affairs Act, and detailed operation methods should be established under the Prime Minister's Ordinance. At this time, not only international trade-related agreements such as the Free Trade Agreement (FTA), but also other domestic laws such as the Basic Law on Intellectual Property and the Monopoly Regulation and Fair Trade Act should be considered.
In this study, a step-by-step roadmap was proposed and the expected effects were analyzed in terms of institutional and industry. In the institutional aspect, the improvement of administrative efficiency in stages, the clarification of the legal basis of the RMP system consistent with the reconsideration of administrative predictability, the unifying of post-marketing safety management systems and international harmony can be expected. In terms of industry, the improvement of civil compliant satisfaction, clarification of RMP system operation, administrative predictability reconsideration and unified medication safety intensive management can be expected. Although efforts were made to minimize confusion caused by sudden system changes by proposing a roadmap for each step, considerable attention is required as it takes a considerable period of time until the final end of the re-examination system. In addition, since the step-by-step law amendment process may not be easy, it is necessary to prepare with the possibility of simultaneously promoting the law amendment to abolish the re-examination system and RMP upward legislative. It can be expected that more efficient and in-depth drug safety management will be achieved through unification of the drug safety management system after marketing.
