Corporal punishment in school, which is called whipping of love, has long been one of social issues that trigger heated disputes, and there is still fierce pros and cons about that. In our country, little restrictions are imposed on corporal punishment as part of customs because of traditional Confucian culture and the widely accepted educational necessity of corporal punishment. However, the way of looking at it has changed, since the human rights of students are accentuated. The purpose of this study was to determine the coverage of effective corporal punishment without infringing on the human rights of students and to discuss how that could be inflicted from an educational perspective. And it's attempted to deal with several research questions, including changes in relevant precedents in relation to the oughtness of corporal punishment, phenomena of violating the human rights of students, the theoretical ground of pros and cons about that, the range of corporal punishment inflicted by elementary school, and workable reform measures. To address the research questions, all sorts of literature concerned were reviewed, involving theses, dissertations, books, publications, earlier studies, data released by different organizations, law, precedents, report by the press and newspaper articles. The findings of the study were as follows: First, there were increasingly less cases to approve the oughtness of corporal punishment, as a more strict standard was applied than before. In recent days, that was legally viewed as a legitimate action if it was necessary for the purpose of education, if other educational measures were impossible to remedy the situation, and if its objective validity was generally admitted. And the kind of corporal punishment that could give physical or mental pain could be used only when it was unavoidable, and it was also the case for the use of words that could depreciate students. Second, teachers often inflicted corporal punishment on students without considering the object of education or its due procedure, and that frequently resulted in violating the basic human rights of students guaranteed by the constitution, such as personal rights, rights to pursue happiness, privilege of equality, physical freedom, right to learn and right to live a manly life. Teachers were aware of the importance of human rights, but they scarcely valued them in real life. And they didn't abide by relevant school regulations well. Students and parents didn't put confidence in corporal punishment inflicted by teachers. Thus, schools and teachers should put more efforts into meeting changing social needs. Third, as for the positives of corporal punishment, they expected it to be effective in maintaining order, to boost the self-controlled learning of students and to produce swift educational effects. Regarding its negatives, they considered it just to curb the undesirable actions of students temporarily, to have a negative impact on learning, to oppress the achievement of learners, to trigger more defiant actions, and to ruin mutual trust between teachers and students. The arguments of those who were for and against corporal punishment were both valid to some extent, but its negatives were more highlighted as the human rights of students came into spotlight. Its negatives should not be overlooked in light of the position of students, since it affects students who are punished more than teachers who inflict corporal punishment. Fourth, concerning the approved coverage of corporal punishment in elementary school, firsthand corporal punishment should be prohibited, and the authority of teachers and the human rights of students must be all taken into account. Teachers must not make an arbitrary interpretation of corporal punishment when they intend to inflict it. That has to be inflicted after creating a trustworthy classroom climate first, and its due procedure must be observed. The use of insulting and foul language should be banned, and collective disciplinary punishment and group corporal punishment should be forbidden as well. Fifth, in order to take advantage of corporal punishment for educational purpose, relevant law and regulations should be revised to prohibit firsthand corporal punishment. The authority of teachers and the human rights of students should be all prized, and a student-friendly school culture should be built. Teachers should improve their language and have a good understanding of children with ADHD. How to diagnose, treat and teach those children should carefully be studied. As for school institution, educational conditions should be improved, and intensive human-right education should be provided to both teachers and students. More practical and authentic education should be offered to would-be teachers as well, and there should be reinforced collaboration among families, schools and local communities. In addition, parent education should be improved. In the future, the human rights of students must be considered in every matter related to education, and corporal punishment should be inflicted not in a way to violate their human rights. And it's more advisable for teachers and students to build a trustworthy relationship with each other to nullify the necessity of corporal punishment.
