Currently, there are legal provisions regarding the definition of “counseling” along with “the duty of counselors” in South Korea whereas “the rights of counselors” have not been established legally.
The purpose of this thesis is to look at such factor critically while urging an enactment of “Counselors Law” to improve the treatment and welfare that are appropriate to counselors, to strengthen the security of Counselors status, to enhance the position of counselor, and to make the necessary factors in relation to counselor to be the legal regulations stipulated by the law and to propose the draft of “Counselors Law”.
For instance, counseling has become a social demand throughout our society as we live in a fast-paced and complex world where it is impossible to escape from the stress even for a moment. Thus, “Counseling” and “Counselors Obligations” are specified in the laws today including Framework Act on Juveniles, Welfare of the Aged Act, School Violence Protection Act, Sexual Violence Protection Act, Prostitution Laws. In other words, it is safe to say that the law also recognizes the necessity of counseling and which it is partially enacted.
However, the provisions enacted regarding the “Counselor” regulates only the counselors legal obligations such as principle of confidentiality, mandatory continuing education, cooperation duties of law enforcement agencies, prohibition of commercial operation, prohibit rejection of counseling. Laws are sets of rights and obligations defined and fixed by the members of the society in order to solve the conflicts. However, the current law in this country only provides the duties to the counselors but do not provide any rights or indicates any social status as counselors.
To compare in particular, other professionals each have their rights guaranteed by the law such as Certified Tax Accountant Act, Attorneys-at-Law Act, Certified Accountant Act, Social Workers Act, Licensed Administrative Agent Act. On the other hand, counselors do not have any specific laws promising their rights despite their dedication and hard work which it seems unfair for counselors when compared to other professionals and the laws for their profession.
Therefore, “Counselors Law” does not exist in this country as of now but to grant and guarantee the rights of counselors, this paper is to propose an enactment of “Counselors Law”. The New York State law regarding counseling were reviewed prior to the proposal of an enactment of “Mental Health Counselors Law” as counseling is more advanced in the United States of America. The overall structure of Counselors Law proposed in this paper for South Korea consists of 8 chapters and 40 articles. For examples, the proper title of counselors is to be “Counselors” who will be qualified to become one upon passing the national certification exam or receiving a doctorate degree in the field that is related to counseling. Also as the rights of counselors, only those who have met the qualifications of becoming a Counselors as mentioned in this code as well as being officially registered with the counselors association can practice counseling. There should be punishment regulations for a person unqualified for Counselor setting up an office or using a similar term that can be misguiding in order to
guarantee the rights of authorized Counselors and their practice.
Furthermore, filing a counseling session report should be mandatory as the Supreme court recognize those records as an evidence. In order to promote the advancement and development of the counselors and their practice, there also should be a regulation for counselors association for its organizational structure and granting the sole authority by stipulating training and providing continued education for counselors as their important tasks.
The overall conclusion of this paper is to 1) organize the laws regarding counseling through the historical review of the laws, 2) cast light on the guaranteed rights in accordance with the obligations of counselors, 3) recognize the importance of the fair and balanced systems guaranteed for counselors, and 4) recognize the significance of laying the foundation of legal stability and rights for counselors.
In addition, the counselors should assess and determine what is necessary and what they can do after redeeming the drat to be legally more suitable in order to have the Board of Education, where it has jurisdiction over counselors, to proceed with the enactment.
