범죄피해자보호제도의 활성화방안에 관한 법적 연구

설상가상으로 범죄발생이 날로 더 흉포화․지능화되어가고 있고 불특정 다수인을 상대로 하는 소위 묻지마 범죄 뿐 아니라 범죄피해 신고자에 대한 보복범죄 역시 꾸준히 발생하고 있다. 이러한 상황에서는 그 동안 정부가 추진한 다양한 범죄피해자보호 대책 및 민간단체의 적극적인 피해자지원 활동을 위축시킬 우려마저 감돌고 있다. 따라서 형사절차에서의 범죄피해자보호제도 전반을 재조명하고 그에 맞는 적절한 대책 마련이 시급하다고 할 것이다. 이에 본 논문은 범죄피해자보호제도의 활성화방안을 제언하기 위한 법적 연구이다. 따라서 본 연구에는 국내외의 범죄피해자학 관련 문헌과 다양한 연구 논문 그리고 범죄피해자 학계의 최근동향이 연구의 토대가 될 것이다. 뿐만 아니라 각국의 범죄피해자보호제도를 비교 분석하고 더 나아가 민간단체의 범죄피해자보호를 위한 역할을 알아보는 과정이 논의의 출발이다. 이러한 연구 과정은 우리의 새로운 범죄피해자보호 및 지원체계를 마련하는데 조금이나마 보탬이 되려는 일념에 의한 것이다. 그 논의의 순서는 다음과 같다.
우선 범죄피해자의 개념 정의 및 피해자화의 단계를 철저히 이해하는 것이 범죄피해자보호의 첫걸음이다. 그리고 범죄피해자보호의 헌법적 근거 및 형사법적 근거가 무엇이며 그 성과에 대한 발자취를 확인해 나가는 과정이 필요하다. 또한 최근 피해자학계에서 부각되고 있는 회복적사법에 관한 논의를 중심으로 범죄피해자보호의 필요성과 기대수요에 대한 연구를 더하고자 한다.
다음으로 우리보다 일찍이 범죄피해자보호에 대한 관심을 가져왔던 미국과 독일 그리고 일본의 범죄피해자보호 법제 및 그 운용실태를 분석 평가해보고 우리의 범죄피해자보호제도의 현황 및 문제점을 비교법적으로 고찰하여 새로운 개선방안을 마련하고자 한다. 특히 피해자의 변호인선임권과 회복적사법의 전형인 형사조정 그리고 배상명령제도에 대한 검토를 집중하고자 한다. 결국 본 연구는 범죄피해자의 신속한 피해회복에 있는 것이다. 한걸음 더 나아가 범죄피해자가 그 피해의 굴레에서 조속히 벗어나 정상적인 사회복귀를 도모하는 것이 논의의 핵심이고 최종 목표인 것이다.

With a growing attention paid to crime victims across the world in the late 20th century, discussions on the protection of crime victims in criminal procedures have been emphasized. Supported by the global trend, Korean government added to the Constitution crime victims' right to make a statement to the court at sentencing and their right to claim for aid, which was an exceptional move. The government also enacted the Act on Crime Victims Protection, which may be considered to be the Bill of Rights with regard to crime victims. These examples signal a new turning point in our perception of crime victims.
Unfortunately, however, the recent crime rates have been on a constant rise. The number of violent crimes committed, such as homicide, robbery, rape, arson, are also far from decreasing, which means that the number of such crime victims inevitably increases on a steady basis. It is no exaggeration to say that this situation is becoming a serious social problem causing an extensive level of physical, psychological and financial distress not only to the victims and but also to their families.
What is worse is that the crimes committed have taken increasingly violent and sophisticated forms, and that hate crimes against random people and retaliatory offenses against witnesses occur constantly. There are concerns that a variety of crime victim protection measures taken so far by the government and aggressive activities to support crime victims performed by private organizations may wane. Therefore, it is urgent to undertake an overall examination of the current system of the crime victim protection in criminal procedures and to provide appropriate measures.
This study of the legislation system aims to suggest measures to promote the crime victim protection system. To do so, it is based on a number of domestic and foreign literature and research papers related to crime victimology and the latest trends in crime victimology research. In addition, it compares the protection systems of different countries and discusses the private organizations' role in the protection of crime victims. This research method is designed with a strong determination to help establish a new system to protect and support crime victims. The discussions analyzed in this study are summed up as follows:
First, clarifying the definition of crime victims and understanding the stages of victimization is the first step to the protection of crime victims. The constitutional and criminal law grounds for crime victim protection are then verified as well as their footsteps. A discussion on restorative justice, a recently highlighted subject in victimology, follows in order to analyze the necessity and expected demands of crime victim protection.
Second, this study analyzes and evaluates the laws on crime victim protection and their real applications in the U.S., Germany and Japan, the nations that have long attended to crime victim protection. It uses a comparative law method to better understand the current situation of and issues related to the protection system in Korea and to draw up new measures to improve the system. In particular, the focus is given to victims' right to appoint defense counsel, and some types of restorative justice, namely criminal mediation and remedy order systems. In the end, this study is all about quick recovery of victims of crime. The key issue and the ultimate goal of the discussions is to help crime victims seek relief from suffering as soon as possible and return to normal social life.
Above all, the most important task is to ensure the basic human rights of crime victims enshrined in the Constitution and to strengthen the standing of crime victims in criminal procedures, thereby creating an environment in which a practical system of crime victim protection can be well established. It should never be forgotten that crime victims are also agents of basic human rights enshrined in the Constitution.
