회갑을 넘긴 현대 한국 교육을 돌아보면 근대화, 산업화, 민주화 과정을 겪으며 선진국 문턱에 다다르고 있는 국가의 성장과 발전에 원동력이 되어 왔음을 인정하지 않을 수 없다. 그러나 이제 다시 한국교육은 이러한 성장의 그늘이 배태한 양극화 현상의 해결사로서의 역할을 주문받고 있으며, 아울러 스스로의 체질개선을 통해 교육수요자들로부터 사랑받는 의무교육, 공교육, 보통교육으로 다시 태어나 대한민국이 선진화로 나아가는 노정에서도 결정적으로 기여해야 한다는 사회적 압력 또한 만만치 않다.
이러한 상황에서 한국은 2004년에서야 9년 의무교육의 무상화를 완성한데 이어 2010년부터는 특수교육의 의무교육기간을 취학전 1년과 고등학교교육을 포함하여 13년으로 확대하였으며, 2011년부터는 실업계 특성화고교가 무상교육을 실시할 예정이다. 그러나 무상의무교육의 제도적인 확대가 교육의 질을 담보한 상태에서 진행되고 있는가에 대한 검토와 반성적 사고가 절실한 시점이고, 우리는 꽤 까다로운 소비자와 교육정책 이해당사자를 보유하여 이것이 때에 따라 교육정책의 기회요인도 되고 위협요인도 된다는 것을 늘 염두에 두고 정책에 임해야 할 필요가 있다.
원래 이 연구는 의무교육에 대한 국제사회의 동향과 지향을 생생하게 진단한 후 메가트랜드를 추출하여 한국의 의무교육 발전을 위한 정책결정과정에 풍부한 현장감 있는 해외정보를 제공하고자 기획되었으나 연구 조건의 제약으로 보다 생생한 해외 사례 수집과 분석은 후속 연구의 과제로 남겨두게 되었다. 본 연구는 각종 문헌과 인터넷 등 매체 자료 분석과 교육전문가들과의 집단지성을 통하여 최근 의무교육 단계에서 새로운 교육개혁 이슈를 가지고 국제적인 주목을 받는 미국, 일본, 호주, 스웨덴, 핀란드의 의무교육 쟁점과 동향을 분석하였으며, 한국의 의무교육제도 발전추이도 탐구하여 향후 의무교육의 발전 방향과 과제를 제안하였다.
일본의 의무교육은 9년으로, 국민 공통의 기초교육으로서 모든 어린이에게 확실하게 기회를 보장하기 위한 법적 구조를 갖추고 있다. 아울러 취학의 의무, 학교설치의 의무, 취학 보장의 의무, 피지의무(避止義務)가 제도화되어 있다. 일본의 의무교육은 일정한 연령으로부터 취학을 시작하여 일정한 연령에 달하면 이수가 인정되는 연령주의를 선택하고 있으며, 의무교육 이수 방법은 취학의무로서 규정하는 동시에 취학 학교를 지정하고 있다.
의무교육의 무상성의 범위는 국공립학교에 있어서의 수업료와 교과서 구입비용이다. 수업료 및 교과서 구입비용 외에 수업을 위한 각종 학습재료비, 급식비 현장 학습비, 교통비 등은 수익자 부담의 원칙에 의해 학부모 부담으로 되어 있다.
일본 정부는 소중(小中)일관교육 등 의무교육기간 내 학교의 연한을 유연하게 하기 위하여 현행법에 있는 ‘9년’의 연한을 재검토함으로써, 학교교육법에서의 의무교육의 위상을 새롭게 정하는 동시에 ‘6·3제’의 탄력화 논의를 가속화하고 있다. 2010학년도부터 ‘고교 무상화법’에 따라 공립 고등학교 등의 수업료를 무상화하고, 사립 고등학교 등에 취학지원금을 지급하고 있다.
미국의 의무교육은 의무출석법에 의하여 규정되며 의무출석법의 목적은 의무적으로 학교에 다녀야 하는 연한을 늘리는 것이며, 주정부는 학습자의 잠재력이 최대한 발휘될 수 있도록 교육 체제를 지원하여야 하는 책임이 있고, 학부모는 자녀를 학교에 보낼 의무가 있다. 미국의 교육은 주정부에서 관여하고 운영하도록 법체계로 명시되어 있어 의무교육기간은 주마다 다소 차이가 있으나, 보통 5-7세에 16-18세까지가 의무교육기간이며, K부터 12학년까지 무상교육을 실시하고 있다.
미국 교육 시스템에서 중요한 점은 의무교육이 반드시 무상을 의미하지 않고 역으로 무상교육이 반드시 의무교육도 아니라는 사실이다. 주정부는 공립교육체계에 한하여 무상으로 서비스를 제공하며, 의무교육의 개념은 미성년 자녀를 학교에 보내서 합당한 교육을 받게 하는 것이 부모의 의무라는 의미가 강하게 담겨 있다. 미국의 공교육 발전은 민주주의가 확장되어 가는 역사와 맥을 같이 한다. 사회적·정치적·경제적 불평등에 따른 교육 기회의 불평등과 차별을 없애기 위하여 교육을 받는 학습자의 대상을 확대하고 계층, 성별, 장애, 언어 장벽에 구애받지 않고 모두 교육을 받을 수 있도록 보장하는 방향으로 나아왔다. 최근 미국의 의무교육 이슈는 공립학교의 민영화, 의무교육 연한 확대, 학교의 책무성 강화이며, 이러한 이슈는 학교선택권과 공교육의 질과 형평성의 문제로 확대되어 정책이 구안되고 있다.
호주의 의무교육인 초·중등교육은 주 정부와 특별구의 정부가 담당하고, 대학은 연방 정부가 재정적으로 지원한다. 따라서 주나 특별구에 따라서 의무교육의 규정이 다르지만, 기본적으로 6·4·2제의 처음 10년(초등교육 6년+전기 중등교육 4년)이 의무 교육에 해당하며, 공립학교의 학비는 무료이고 교과서나 학교 준비물 등은 학부모가 부담한다.
호주 학교 교육의 목표는 2008년 12월 발표한 ‘호주 학생 교육 목표에 대한 멜버른 선언’에 잘 나타나 있다. 호주의 교육은 고유한 문화의 가치를 중요하게 여기고, 다문화 속에서 결집력 있는 사회를 만들어 나가기 위한 인재를 양성하고자, 첫째, 형평성과 수월성을 추구하고, 둘째, 학생들이 자신감과 창의성이 넘치고 성공적인 학습자가 될 수 있도록 가르치고자 한다. 이를 위하여 교육에 관계되는 모든 주체들인 학교와 정부, 학생과 학부모, 후견인, 가정과 지역사회, 경제계와 사회 전체가 동반자적 관계를 형성하는 것을 무엇보다 강조하고 있다. 또한 호주 원주민 문화에 대한 이해와 개발, 아시아 문화와 언어에 대한 이해와 같은 문화의 중요성, 유아교육 강화를 통한 학습에 대한 준비성 제고, 지식의 기초를 단련하는 중학교 교육의 중요성, 호주 원주민과 소외 계층의 학력 향상을 위한 교육 과정과 평가 과정의 개선 등이 의무교육개혁 과제이다.
최근 호주의 의무 교육은 변화하고 있다. 공적자금으로 운영되는 공립학교에 비지니스·시장 모델의 운영방식이 적용되는 학교의 민영화가 이루어지고 있으며, 정부가 제도권 교육의 성공이 취학전 아동교육의 접근성에 달려 있다는 것을 인지하여 유아교육을 정책적·재정적으로 지원하고 있고, 의무교육 연령을 17세로 연장하는 정책을 제안하였다.
스웨덴은 1962년 종합학교 개혁 이래 단선형 학제를 채택하여 평등성을 강조해 왔다. 의무교육 기간 동안 급식을 비롯한 모든 교구, 교재는 무상으로 제공되며, 의무교육은 독립적 시민으로서의 자질과 기초를 형성하는 기초적 과정이다. 스웨덴에서 의무교육은 의무취학을 의미하며, 교육기간은 초등학교 1학년에서 9학년까지로, 9년제 종합학교(comprehensive school)에 취학하는 것을 원칙으로 한다. 의무교육은 아동과 청소년들이 국가교육체제에서 교육받을 권리와 연결되어 있다. 의무취학은 아동이 만 7세가 되는 해(가을학기)부터 적용되며, 의무취학은 학생의 16세 생일이 있는 봄학기까지 종료되어야 하며, 특수학교의 경우는 17세까지이다. 만일 학생이 교육받을 능력은 있으나 9학년 과정을 성공적으로 이수하지 못했을 경우 의무취학기간이 종료된 후 최대 2년까지 학업을 완료할 수 있는 기회를 준다.
스웨덴은 전 단계 무상교육을 실시하고 있다. 취학전교육에 대해서는 소득에 반비례하여 학비징수를 할 수 있지만, 후기중등교육, 고등교육 등은 전면 무상이며 성인교육에 대해서도 무상교육이 적용된다. 스웨덴에서의 의무·무상교육은 사회구성원의 교육적 기본 권리로, 유아교육에서 성인교육단계를 아우르는 전체 제도 맥락 안에서 안정적으로 정착되어 왔다. 교육은 개인 삶의 기회를 결정하는 기초적 요소로서 매우 존중되고 있으며, 개인의 발전과 국가사회의 발전이 연계되어 있다는 인식이 강하다.
핀란드 교육의 근본 목표는 교육수준을 높이고 교육체계의 효율성을 향상시키며 학생들이 배제되지 않도록 방지하고, 성인 교육기회를 증가시키는 데 있다. 핀란드의 교육정책은 복지적 관점과 평등주의 원칙을 고수하고 있으며, 이는 사회 연대적 공동체 정신에 입각한 보편적인 복지를 추구하는 사회적 풍토에 기반 한다.

핀란드 교육을 성공으로 이끄는 기본적인 원칙은 모두를 위한 기본적인 공통의 교육, 양질의 교사, 지적인 책무성, 학교와 교사를 신뢰하는 문화, 일관성 있는 교육정책 추진에 따른 유지되는 리더십이다. 핀란드는 교육기회의 평등과 형평성의 원칙을 지키며, 사회적 합의에 바탕을 두고 교육 정책이 추진되고 있다는 점에서 세계 교육계가 주목하고 있다.
한국의 의무교육제도는 의무교육 태동기(1945-1952), 의무교육 기반 조성기(1952-1959), 수용능력 확충기(1960-1969), 의무교육 정착기(1970-1979), 의무교육 확대실시기(1980-현재)를 거쳐 양적 성장을 이루었다. 이제는 이러한 양적 성장을 기반으로 교육여건 개선 등 질 제고, 무상의 범위 확대, 통합된 국민기초교육으로서의 의무교육의 성격과 정체성 확립을 통하여 의무교육의 질적 수월성을 확보하고 만족도를 제고해야 할 것이다.
이를 위하여 한국은 의무교육 단계별 정체성을 확립하여 교육목표와 교육활동의 초점을 분명히 하여야 한다. 특히 의무교육을 마치는 중학교교육의 정체성을 진로탐색기로 정하고 가장 성장이 왕성한 이시기 청소년들의 몸과 맘이 균형 있게 성장할 수 있도록 다양한 역동적인 교수학습방법을 활용하고 재미있는 ‘진로탐색프로그램’을 도입하도록 한다. 또한 의무교육의 질과 만족도를 높이기 위한 다각도의 노력이 절실하고 그중에서도 그동안 단편적인 성취를 추구하느라 빼앗긴 학습의 즐거움과 학교 내 인간관계를 증진시킬 수 있는 ‘즐거운 학교 만들기’ 프로젝트를 가동하도록 하고, 이러한 프로젝트는 위에서 밑으로 정책방안을 내려 보내는 방식이 아니라 현장의 아이디어와 열정으로 즐겁게 집행될 수 있도록 현장과 전략적으로 소통하며 섬세하게 지원하여야 한다. 더불어 교육에 대한 기대가 높은 까다로운 한국의 교육수요자의 요구와 필요에 대응하기위하여 의무교육기간을 늘리기보다는 무상교육의 단계와 범위를 확장하도록 하고, 이에 필요한 정부부담 공교육비를 교육경쟁력이 높은 교육 강국 수준으로 차근차근 늘려가야 할 것이다.

Increasingly changing educational environments, represented by accelerated globalization, limitless competition among nations, rapidly developing technologies, and the advent of newly emerging knowledge-based society have had impacted the ways in which educational policies are formed and implemented around the world. As various international organizations have published national competitiveness indexes, elementary and secondary education has become one of the fundamental indexes that indicate how advanced and strong each nation’s competitiveness is and international education competition becomes more and more intense.
Korean education has been a driving force for the development and growth of the nation, which went through modernization, industrialization, and democratization and the nation is on the road to becoming a developed country. However, Korean education is expected to become the cure-all for many social problems that have been caused by dramatically rapid economic growth, such an inequitable distribution of wealth and increasing economic and social polarization. There has been a tremendous amount of social pressure demanding that Korean education should contribute to the course of the nation becoming an advanced society by improving its own structure and qualities and that Korean education should be revitalized by providing high quality compulsory, public and universal education.
Korean education is characterized by having made its 9 year long elementary education free and universal in 2004 and in 2010 it made it compulsory for special needs students to receive 13 year free education including kindergarten and three years of secondary education. From 2011, secondary education specialized in trade and business will be provided free of tuition. Yet, it is necessary to critically examine and reflect the current expansion of free education when it could compromise the overall quality of Korean education. Moreover, we should take into consideration the fact that we do have educational consumers and stakeholders who are particular about the quality of services that they receive and that this might be opportunities as well as risks for the development and implementation of education policies.
Originally, this study intended to provide on-site information and resources which would realistically contribute to the process of developing education policy for the improvement of Korean compulsory education, collected from examining international trends and directions of education. Thus, this study planned to visit many educationally advanced countries to gather on-site and meaningful information regarding the success of their education to help to improve Korean education. However, it had to be modified due to unforeseen changes in circumstances in the planning stage.
Thus, this study attempted to achieve its originally intended objectives by collecting and analyzing sources which are available in literature and online and with continuous discussion among educational experts. The study analyzed the systems of compulsory education of the countries of which academic performance received a great deal of attention internationally, such as USA, Japan, Australia, Sweden and Finland so that findings from studying these countries’ educational trends could contribute to developing and improving Korean compulsory education.
In Japan, compulsory education is 9 years. Compulsory education in Japan is legally established in order to provide all Japanese children with basic and universal education along with duties of school attendance, building educational facilities, guaranteeing school attendance, and not using child labor. Japanese compulsory education uses children’s age as a standard to complete compulsory education and the methods of receiving compulsory education are regulated as duties of school attendance.
The scope of free education is limited to tuition and cost of textbooks for public schools in Japan. Other education-related expenses, such as school supplies, field trips, lunch and transportation are paid by parents according to the user-pays principle. The Japanese government is reexamining the 9 years of compulsory education and re-established the importance of compulsory education by leaving room for having there lated legislature modified in the future to promote the flexible management of integrated school system between primary and middle levels(6+3). Beginning in 2010, Japan provides public secondary education free of tuition and offers subsidies for private high schools.
In the United States, compulsory education is characterized by its compulsory attendance law. Compulsory attendance law prescribes the state’s responsibility to provide educational facilities for students and finance them and parents’ obligation to send their children to school. It varies state from state, but the period during which students should attend school is usually 10-13years. Public education is provided free of charge. One of the important things with regard to the US education system is compulsory education is not necessarily free education and vice versa. The state government is responsible for providing free and universal education for its residents and the notion of compulsory education is more strongly related to parental responsibility to have their children educated. The historical development of American public education is the process of expanding democracy. It has developed in the direction where all children have equal educational opportunity regardless of their backgrounds, such as race, class, gender, languages, nationality, and disability. The current issues that American public education are the trends of privatization of public schools, the expansion of the years of compulsory attendance, increasing focus on account ability and these issues are being interpreted as educational policies in regards to the issues of high quality public education and equity.
In Australia, states and territories are responsible for elementary and secondary education and the Commonwealth government is responsible for tertiary education. Accordingly, the law on compulsory attendance varies depending on states or territories and usually lasts first 10 years (6years of elementary education and 4years of lower secondary education). Public education in Australia is provided with no tuition, yet, parents or guardian spay for text books and school supplies. The main goals of Australian education were declared in the “Melbourne Declaration on Educational Goals for Young Australians”in December, 2008. The main goals are to promote equity and excellence and to have all young Australians become successful learners with creativity in order to build a democratic, equitable, and just society which values cultural diversity. In order to achieve these goals, parents, guardians, families, communities and business sectors are encouraged to develop stronger partnerships. In addition, under standing their Indigenous culture, Asian cultures and languages, strengthening early childhood education and middle school education, reforms on curriculum and assessment for improving educational outcomes for Indigenous and disadvantaged students are the most representative issues of Australian education.
Recently, Australian education begins to adopt the business model to publicly funded schools and governments increases financial assistance to increase the accessibility of early childhood education and proposes to increase compulsory attendance until a child is 17 years old.
Sweden has focused on equity by choosing a single linear educational system since the comprehensive school reform in 1962. Everything including tuition, textbooks, school supplies is provided free of charge during the period of compulsory education and compulsory schooling is considered when the foundation of becoming independent citizens is formed. Compulsory education in Sweden means compulsory school attendance and it lasts from 1st grade to 9th grade. Swedish children attend a comprehensive school that has 1st through 9th grade. The notion of compulsory education usually means children’s right to receive education. Compulsory attendance applies to fall of the year when a child turns 7 years old and terminates in spring of the year when a child turns 16 years old. Compulsory education extends up to 17 years old when a child has special needs. When a student has the ability to learn, yet failed to finish 9 year course, he or she will be given an opportunity to complete their schooling 2 years after the age limit has passed.
Sweden provides free education for all levels including post-compulsory education except for early childhood education (preschool education). Sweden regards compulsory and free education as the fundamental right as members of society and has been institutionally established historically. Swedish people consider education to be one of the most important factors to determine the quality of life opportunities and it to be closely related to the improvement of society and the nation.
Finnish education has received international attention because of its excellent academic performance recently. The basic goals of Finnish education is to improve the overall quality of education and increase the efficiency and effectiveness of its educational system and to promote inclusion of all students and increase opportunities of lifelong education. The main principles of Finnish education are equity and welfare and they are derived from its social atmosphere where communities are considered essential to their lives. Finland also underwent the major comprehensive school reform in the 70s and comprehensive schools provide elementary and lower secondary education as part of compulsory schooling. Finland provides 9 years of compulsory education and after completing 9 years of schooling, students are eligible to go further with their education. Finnish high schools provide general education and vocational education and training and after wards, they can go to college and polytechnics. Finland provides post-compulsory education free of charge and one year of pre school education before compulsory schooling begins is provided free yet, it is not required.
The factors of the success of Finnish education are its faith in common and universal education, highly qualified teachers, emphasis on intelligent accountability, trust in teachers and schools, and excellent leadership that produces consistent and principled educational policies. Finnish education has received an international attention as it maintains the principles of equity and equality of educational opportunity and the implementation of educational policies based on social consensus.
Korean compulsory education has arrived at its current state by having expanded quantitatively over the years. Now, it is optimal time to promote and improve its quality, to expand the scope of free education, to establish its goals as offering basic universal education for Korean citizens. It also demands to meet the needs of educational consumers by pursing excellence in quality and improved satisfaction for educational stakeholder.
There are several recommendations that can be made from the findings of this study. Korean compulsory education should establish its main goals and objectives of each level of education and clarify educational objectives. In particular, middle school years should be when students explore and pursue their future and career interests and where various pedagogical practices are utilized for physically and intellectually active adolescents so that they can develop their bodies and minds in a balanced way. In middle schools years, “career exploration programs” can be implemented to induce useful interests for middle school students for their future.
Multi-faceted endeavors to increase satisfaction about educational services are necessary and “creating fun and exciting schools” projects that could revive interest and fun in learning and human relationships in schools which have been lost due to pursuing short-term and immediate achievement should be activated. These types of programs should not be initiated from the top administration, but rather should be created and tried in individual schools with detailed support from the government with the help of open communication between schools and governments. Moreover, it is recommended that the expansion of the scope of free education is more encouraged than the expansion of compulsory schooling years in order to meet the demands and high expectations of educational consumers and accordingly, public funds for education should be gradually increased to improve the quality of Korean compulsory education to match those of educationally advanced countries.
