그러나 과거 불법 과다 지원금을 지급받은 사람들 혹은 주변의 과다 지원금을 받은 사람이 있는 경우 법 시행 이후 지원금 지급 수준이 줄고 단말기 초기 구입비용이 증가하는 것으로 체감하여 불만을 지속적으로 제기하고 있다. 다만, 법 시행 이후 이동통신 3사의 마케팅비는 예년과 비슷한 수준으로 지원금 지급 수준이 감소했다고 단정 지을 수 없으며, 요금제 및 가입유형에 따른 지원금 차별이 금지되고, 지원금을 받지 않는 이용자에 대한 요금할인이 의무화됨에 따라 소수에게 지급되던 지원금 총액이 다수에게 분배되어 체감상 지원금 지급액이 감소한 것으로 느낄 수 있다.
서비스 개통 건수 및 단말기 판매량이 이전의 감소추세에서 벗어나 증가한 것 등을 보았을 때 시장이 위축된 것은 사실과 다르나, 휴대폰 시장 위축으로 국내 제조업계, 판매점 등이 어려움에 봉착했다는 논란이 제기되고 있다. 단말기 시장이 과거와 달리 프리미엄폰 위주에서 벗어나 중저가 단말기가 확산되고, 판매점 중심의 유통구조에서 직영점·대리점이 증가함에 따라 관련 업계의 경영상 부담이 증가하고 있는 것으로 파악된다. 과거와 달리 시장이 안정화되고 위법행위가 줄어들었으나, 여전히 일부에서 불법지원금이 지급되고 있다.

첫째, 가장 중요한 이슈 중 하나인 지원금 상한제의 필요성을 살펴보면, 상한제는 지원금 지급수준을 제한함으로써 과도한 지원금 지급을 방지하는 역할을 하므로 지원금 상한액까지 제공되는 단말기는 상한제 일몰 시 지원금이 증가할 가능성이 있다. 또한, 상한제는 지원금을 고려한 출고가 부풀리기를 억제하고 출고가를 경쟁적인 수준으로 인하하도록 가격적 유인을 제공하는 역할, 소모적인 지원금 경쟁을 지양하고 확보된 요금 인하 여력을 요금 인하로 유도하는 역할, 고가 요금제 가입자에게 지급되는 최대 지원금을 제한하여 이용자의 불필요한 고가요금제 가입을 방지하고 저가요금제 가입자와 고가요금제 가입자 간 차별을 완화하는 역할 등을 한다. 따라서 상한제 일몰 시 출고가 인하 및 단말시장 경쟁 촉진, 요금 인하 및 알뜰폰 활성화, 고가요금제 유인 및 이용자 차별 측면에서 부정적 영향을 미치겠지만, 그 크기가 제한적일 것으로 예측된다. 그 이유는 상한제 외에도 지원금 공시, 비례성 원칙, 지원금에 상응하는 요금할인 등이 각 요소들에 보완적으로 영향을 미칠 수 있기 때문이다. 다만, 일몰 효과를 보다 정확히 예측하고 일몰 시 시장혼란을 완화하기 위하여 단계적으로 상한을 인상하는 방안을 검토할 필요가 있다. 또한, 상한제의 보완적 수단으로 지원금 급변동을 억제하기 위하여 공시주기를 연장하는 방안, 지원금 하한을 설정하는 방안 등도 고려 가능하다.
둘째, 법 시행으로 인한 시장 동태성 저해가 그다지 크지 않은 수준으로 판단되나 지속적인 모니터링이 요청된다. 다만, 현 시점에서 번호이동에 대한 추가적인 지원금을 허용하는 방안은 면밀한 검토가 필요하다. 추가적인 지원금 허용수준을 산정하기 위하여는 이동통신서비스 시장의 전환비용을 추정하여야 하나, 관련 연구결과가 극소수에 불과하며 이마저도 상당히 제약적인 가정을 이용하여 합의 도출이 용이하지 않기 때문이다. 한편, 기존 연구결과들이 최소한 위약금 이상의 전환비용이 존재하고 있음을 시사하고 있고, 미국 및 일본의 경우 위약금 대납이 행해지거나 허용되고 있어, 위약금 대납 또는 평균 위약금에 상당하는 추가 지원금 지급을 허용하는 방안이 있으나, 무제한적인 위약금 대납을 허용할 경우 이용자의 불필요한 단말기 교체를 유발하고 전환비용이 낮은 후발사업자에게 오히려 불리할 가능성이 존재한다. 다만, 현재 약정 18개월 이후 기기변경 시 위약금이 유예(6개월 후 면제)되어 오히려 기기변경에 유리한 상황이므로, 18개월 이후에만 위약금 대납 등을 허용함으로써 가입유형별 차별을 시정하는 방안을 검토할 필요가 있다.
셋째, 비례 원칙이 일부 개선되었으나 여전히 고가요금제 가입자와 저가요금제 가입자간 지원금 격차가 큰 상황이며, 특히 상한제 일몰 시 그 격차가 더욱 커져서 이용자 차별및 고가요금제 가입 유인 효과가 확대될 것으로 예측된다. 또한, 위약금 부과 시 서비스 약정과 무관한 제조사 지원금을 분리하지 않고 이동통신사업자 지원금과 합하여 위약금을 부과하는 것에 대하여 비판이 제기되고 있다. 따라서 제조사 평균 지원금에 상응하는 지원금 하한을 설정함으로써 저가요금제 가입자에 대한 지원금을 증가시키고, 이에 대하여는 위약금을 부과하지 않도록 하는 방안이 바람직할 것으로 판단된다.
넷째, 15개월 이상 구형 단말에 대하여는 상한제 적용을 제외하고 있는데, 이를 12개월 등으로 단축하여 사업자의 자율성을 확대하고 상한제 일몰에 대비할 필요가 있다. 다만, 프리미엄 스마트폰의 경우 통상 1년 주기인 후속 모델 출시 즈음 출고가 인하가 이루어지는 경우가 많기 때문에 기준 완화로 인하여 출고가 인하를 저해할 가능성이 있다. 따라서 구형 단말 기준을 완화하면 출시 이후의 출고가 인하에 부정적 영향을 미칠 것으로 예측되나, 최초 출고가 인하 효과는 계속 유지되고, 법 시행 이전에도 후속 모델 출시 즈음 출고가 인하가 이루어졌음을 고려할 때 그 영향이 제한적일 것으로 판단된다.
다섯째, 법 제정 시 도입이 논의되었던 분리 공시제가 제조사의 영업비밀 침해 및 해외 협상력 약화 우려로 무산되었으나, 제조사 지원금 상당의 출고가 인하, 제조사 지원금에 대한 위약금 부과 금지, 저가요금제 지원금 증가 등을 위해 도입 필요성이 지속적으로 제기되고 있다. 하지만 분리 공시 시행 시 지원금에 상응하는 요금할인율을 산정함에 있어 제조사 지원금을 제외함으로써 할인율이 인하될 가능성이 있다. 또한, 제조사는 프리미엄 이미지 유지 및 해외 협상력 등을 위해 출고가를 인하하지 않고, 출고가 인하 및 차별적 지원금 지급에 대한 여론 부담으로 지원금 규모를 축소하여 단말 구입 부담이 오히려 증가할 가능성도 존재한다.

As a result of the implementation of the MDDA, which stipulates public announce of the subsidy, prohibition of discriminatory subsidy, some positive effects emerges such as breaking the vicious circle of the overheated subsidy competition and penalty, more stabilized market, and sound competition. In addition, the framework of competition in the communication market has undergone changes from an exhaustive competitive behavior characterized as a war of attrition using a subsidy to a competition based on the fee, service, device, factory price. As the market competition intensify, and as the reasonable consumption pattern of the consumers settle down, the consumer welfare arises due to the reduced communication expense.
The unequal distribution of subsidies have been improved, which was formerly weighted toward subscribers with number portability intention or paying more expensive pricing tiers, with more subsidies given non-discriminatorily to the subscribers who only changed devices without switching carriers or signed up for cheaper plans. Subscribers benefited from the widened choice to select discounted bill instead of subsidies. Communication expenses per household are on the decrease with the more reasonable consumption pattern being established. The average factory prices for devices were lowered, and the expense burden placed on the subscribers was alleviated because the device market competition have been intensified and more medium to low-end handsets have been rolled out due to the newly formed competitive environment based on the performance and price. However, complaints about a reduced level of subsidies and an increased initial cost perceived after the enactment of the MDDA have been continuously filed, which are possibly because the complaining users or their acquaintance had past experience with illicit subsidies set at an excessive level. But the reduction in the total amount of the subsidies cannot be assured considering the fact that the three mobile communications operators appear to have spent similar marketing expenses after the enactment compared to the previous years. Public perception about the reduced subsidies might be attributable to the prohibition of the discriminatory subsidy payment by the subscription type, mandatory discount offering to the subscribers who opted out of the subsidies, and the ensuing redistribution of the total discounts among subscribers from the few beneficiaries to the majority.
The claim that the mobile communication market suffered from depression as a result of the MDDA is not consistent with the fact that the activation rate for the mobile services and the devices sales figure have recovered out of the decline and shows an upward trend. But there remains a controversy that the mobile handset manufacturers and sales agents are experiencing difficulties due to the depressed device market. As the focus of the mobile device market has moved away from the premium flagship devices to the mid and low-end devices, the role of the sales stores, who were the major player in the device distribution chain diminished as carrier-owned outlets and agents increases, which results in the economic hardship to the related businesses. Unlike the previously common practices, the market became stabilized, infringement cases decreased. Still some illicit subsidy payment practices survived.
It is true that the enactment of the MDDA has achieved expected legislative intent mentioned above, but remaining issues have to be fully addressed for further improvements.
First, with regard to necessity of setting an upper limit of the subsidy, one of the most important issue, the upper limit plays a role in preventing excessive subsidy payment by limiting maximum subsidy payable, and if the maximum subsidy regulation expires by a sunset provision, it is possible to predict the increase in subsidy. Also, upper limits of the subsidy plays various roles entrusted by the law, such as suppressing overpricing practices for factory price considering the amount discounted granted to the users as a subsidy, providing incentive to set or lower factory price at the competitive level, inducing operators to lower price with enough discount capacity secured by avoiding exhaustive subsidy competition. Limiting maximum subsidies payable to the those who pay for more expensive plans discourages users from choosing unnecessarily costlier pricing tier and mitigates the discrimination in the subsidy payment among subscribers with low-cost plans and expensive plans. The expiration of the subsidy-capping regulation by the sunset provisions would negatively affect the intended policy goals such as lowering factory price, promoting device market competition, cutting rates, invigorating MVNOs, and deterring luring into the expensive plan and user discrimination, but it is expected to have only limited impact as the regulatory gap left by the sunset could be to some extent filled with the complementary effect of other regulations, such as the public announcement of the subsidy, the principle of proportional subsidy payment, obligation to correspondingly discount rates in lieu of the subsidy. Nevertheless, it would be desirable to consider gradually raising the subsidy cap to better predict possible impacts of the sunset and to mitigate a market disorder after the sunsetting. And there is an option to take supplementary measures to prevent drastic fluctuation of the subsidies, which include extending the cycle of the public announcement and setting a subsidy floor.
Second, the constant monitoring is required even though the reduced market dynamism caused by the enactment of the MDDA appears not to be significant. But allowing more subsidy payment to those who change mobile operators at this point warrants closer examination. To calculate the permissible range of the additional subsidy, estimating the switching cost of the mobile communication service is necessary, but the relevant research is severely lacking and the existing few studies relied on the restrictive assumptions which make it harder to draw a consensus. On the other hand, previous studies suggested that the switching cost would exceed at least the early termination fee(ETF), and the practice of paying off the early termination fee for switching customers have existed or legally accepted in the US and Japan. In this light, one conceivable improvement can be to allow the operators to pay off the ETF or to pay an additional corresponding subsidy. However, unrestricted paying off of the ETF may induce unnecessary device switches and may have unintended adverse consequences on the competitiveness of follower operators with a lower switching cost. Another possible way to remedy a discrimination by the subscription type is to allow the paying off of the ETF only after the 18 months lapse, considering that under the current practices, after 18 months have passed, the terms for switching devices become more favorable because the operators would defer the ETF payment(which will be waived after additional 6-month lapse) when a user switch devices after maintaining a contract for 18 months.
Third, the principle of proportional subsidy payment has been improved in part, but the significant subsidy gap persists between users with an expensive subscription, and an affordable subscription, the sunset of the subsidy cap is expected to worsen the gap resulting in user discrimination and luring into the expensive plans. One criticism is that the mobile operators impose the ETF in a lump without separating the portion of subsidy for the service from the amount subsidized by the device manufacturer regardless of the service contract. Therefore, to increase the subsidy payment for low-cost users, it would be desirable to set a subsidy floor with reference to the average subsidy paid by the device manufacturers and make it excluded from the ETF.
Fourth, the current regulation exempts the outdated devices more than 15 months old from the application of the subsidy cap, but it would be advisable to reduce the term to 12 months, thereby giving more discretion to the operators and making preparation before the sunset date is reached. It should be noted that this deregulation might discourage the genuine reduction of the factory price since the factory price of the high-end smartphones tends to drop following a one-year cycle of launching new products. Thus some negative effect on the factory price decrease after the device release is predictable after relaxing the outdated model exception, but the limited impact is expected because the initial reducing effect on the factory price will still remain effective and the factory price has been concomitant with the new model launch even before the MDDA enacted.
Fifth, the separate subsidy disclosure requirements, which failed to be introduced in the initial legislation due to the concerns that the device maker subsidy constitutes a trade secret and the disclosure requirement weaken the bargaining power of the manufacturers overseas, have been continuously called for on the ground that such disclosure requirements would induce the manufacturers to lower the factory price at first as much as the sum of the manufacturer subsidy, would prevent the mobile operators from demanding ETF for the manufacturer subsidy, and would improve the subsidy distribution in favor of the low-cost plans. However, a difficult issue can arise in calculating the corresponding discount rate in lieu of the subsidy under the separate subsidy disclosure requirements, and actual discount rate might be decreased because of the exclusion of the amount the manufacturers subsidized. Also, there is a possibility for manufacturers not to cut the factory prices domestically to maintain a luxury brand image and bargaining power overseas, and to reduce their share of subsidies in fear of the negative public sentiment to lower the factory price and the criticism against the discriminatory subsidy payment. The unintended consequence could be the increased financial burdens on the mobile device purchasers.
Sixth, the obligation to submit relevant information by the manufacturers will expire on September 2017. A proper way to secure requisite information is necessary because “Bring your own device” trend is on the increase due to the discount in lieu of the subsidy policy, and more distributors purchases devices directly from the manufacturers bypassing the distribution level of the mobile operators. The reporting obligation for the manufacturers merits a renewal to prevent a sudden fluctuation of subsidies as a result of manufacturers increasing sales incentive paid directly to the distributors after the subsidy cap regulation expires.
