Before the rapid escalation in real estate prices that initiated in 2001, only Property Tax, a local tax, was levied from real estate owners. The new Law was promulgated and enforced as of January 5th of 2005. It collected higher rate of tax from owners of lands and houses worth more than a certain amount to deter real estate speculation. Another purpose of the Law was to alleviate imbalance in finance among local governments by transferring revenue from comprehensive real estate taxes to local governments. It also aimed to alleviate imbalance in income distribution.
The System of Comprehensive Real Estate Holding Tax had caused controversy since its enactment, and some key articles had to be amended 1n 2005 and 2008 to become what it is today. But, there still remain problems in the Law. First, of all Korean citizens, only a small group of tax payers are subjected to taxation because it collects tax from the owners of lands and houses that are worth more than a certain amount. Second, it combines all lands or houses that each tax payer owns when estimating tax basis. Third, its tax rate is much higher than that of Property Tax. Fourth, what is supposed to be a local tax is first levied by the central government and then distributed to local governments, which may infringe on local governmentsindependent taxation rights.

Therefore, this study suggests that the Comprehensive Real Estate Holding Tax(a national tax) and the Property Tax(a local tax) be merged into one Property Tax that local governments impose and collect according to the current taxation system of Property Tax. It must be pointed out that this merger will cause problems to financial administration of local governments since local governments will lose the Comprehensive Real Estate Delivery Tax from the central government, while gaining relatively small additional Property Tax. Other problems may be caused because of difference in tax basis, tax rates and tax amount of two taxations.
Therefore, the following measures of reorganization in the future to harmonize ideals with realities are recommended.
First, the government of county collects taxes from houses, while it jointly collects taxes from lands with the government of province.
Second, while imposing current Property Tax on each house, the government of province imposes tax on accumulated land within its jurisdiction.
Third, tax rates should be adjusted so that no tax payers bear more burden of tax after merger.
Fourth, the government of county should levy property taxes for houses which will be used for its own finance. The government of county and the government of province jointly levy taxes for lands, and devide up the revenue according to related laws and ordinances. The former will use the revenue from land property tax as its own finance. The latter will allocate the revenue to resolve the imbalance among governments of county.
Real Estate Property Tax is in large part a price for various public services provided by local government, such as public security, fire extinguishing, water and sewage, road building and street lights.
We should follow the law making trend in most foreign countries to have local governments collect property taxes on real estate and improve their finance.
