즉, 9.11 테러 이후 동시다발적인 테러위험이나, 위 개정 협약에서 강화된 환경손해 등에 대하여 보험시장이 그 위험인수를 꺼리고 있어 이를 담보할 방법의 모색이 필요한 실정이며 이와 아울러 우리나라의 배상조치액 수준이 타국에 비하여 상대적으로 매우 낮은 현실을 개선할 방안의 모색이 필요하다. 또 3억 SDR로 설정된 현행의 책임한도를 넘는 손해가 발생할 경우의 추가보상 문제가 검토되어야 하며, 미국이 주도한 보충배상협약(CSC) 의 참여 문제 역시 해결되어야 할 문제이다.
이에 본 연구에서는 손해배상책임 한도 초과손해의 배상(CSC 가입방안 포함), 배상조치액 인상, 환경손해/테러위험 등 보험시장이 인수를 거절하는 위험의 담보방안, 책임보험과 보상계약 간의 분담위험의 재조정 방안을 마련하고, 보충배상 가입 문제를 검토하였으며, 이를 이행하기 위한 법령 개정안을 제시하였다.
마지막으로 상술한 문제 이외에 원자력손해배상 법제 개선에 추가 검토되어야 할 개선 과제를 도출하였다.

First of all, we examined the outline of the Korean nuclear damage compensation system and international nuclear damage compensation regime as a starting point of this discussion.
Next, we analyzed the environmental damages and terror risks and derived institutional reform proposals for them. Environmental damage was explicitly included in the concept of nuclear damage when the Nuclear Liability Act was amended in 2001, but it is unclear whether it will be covered by the insurance market. The insurance market is reluctant to underwrite these risks as the extension of the claim period, the increasing cost of litigation defense, the difficulty of determining claimants, and the shortage of insurance leverage have all emerged as key difficulties.
The terror risk has traditionally fallen within the scope of the operator’s liability and therefore was covered by insurance. However, the insurance market is reluctant to underwrite the risk of recent terrorist attacks that took place in different places at the same time. The Korean financial security system consists of liability insurance and indemnity agreement if deposition is excluded, as it is not utilized. The indemnity agreement refer to the system where the government warrants risks that are not covered by the liability insurance. Therefore, it is apparently desirable that the indemnity agreements cover environmental damages or terror risks which the insurance market refuses or is reluctant to underwrite.
Next, we reviewed the adequacy of the current financial security level. The current limit of the operator’s liability is 300 million SDR but the maximum financial security amount is 50 billion won in the case of a nuclear power plant. The level of financial security is substantially lower in the case of other nuclear facilities or activities than those in other countries, actually violating the congruence principle between liability and coverage. Therefore, it is believed that the financial security of a power plant should be increased to 300 million SDR, which is the liability amount limit, and the financial security of the other operators should be greatly raised in consideration of their risk factors and with reference to other legislation examples.
It is highly probable that the operator’s compensation limit of 300 millio SDR under the current law will be insufficient to fully compensate for damages in the case of a large-scale incident. Therefore, measures should be considered where the previous unlimited liability system should be reinstated or the government should assume responsibility for the compensation of damages exceeding the limit. These measures are hardly likely to be introduced, however, considering that a practical limit exists for available financial security, or the measures would breach the principle of market economy. Therefore, it is believed to be a practical option for Korea to reduce the potential compensation shortage by ratifying the 1997 Convention on Supplementary Compensation for Nuclear Damage. The operators or the government may actively utilize the Convention as they can increase the liability limit to the sum of 300 million SDR and the supplement fund without any substantial fiscal burden. So, we determined that it would be a most desirable policy direction for Korea to increase the limit by the supplement fund by ratifying the Convention.
Next, we also considered that Korea’s ratification of the Convention would create a base for its nuclear industry to advance into foreign markets, that a legal stability would be secured under the international civil proceedings law, that the ratification would be a measure capable of partly resolving the issue of insufficient liability limit, and that it would have the effect that accommodation would be enhanced to match the position of Korea, a nuclear industry state. On the other hand, we should consider that the ratification would impose a fiscal burden on the operators or the government and, most of all, that the effectiveness of the Convention would depend on ratification by neighboring countries which belong to the true, common risk. It is also mentioned that Korea should decide on the ratification by carefully considering such diverse areas of national interest as diplomacy and overseas advancement of the nuclear industry while watching the movement of the neighboring countries under these conditions.
We also examined the issue of local legislation in preparation for Korea’s ratification of the Convention.
